Letter of ALPA Requesting Federal Register Publication of Petition and Notice for Comment | Exemption - Flight Crew Rest |
On February 15, 2002, the Federal Express Corporation d /b / a FedEx Express filed a Petition for Exemption from 14 C.F.R. § 121.503(b) (Petition) with. the Department of Transportation (DOT). The Air Line Pilots Association ("ALFA") is the collective bargaining agent for approximately 64,000 pilots in the employ of 43 airlines in the United States and Canada. ALPA requests that the Petition be published for notice and comment in the Federal Register in accordance with the Administrative Procedures Act and 14 C.F.R. § 11.85. ALPA believes that the issue of flight and duty time limitations is of such importance to flight safety and of such great interest that there is no good cause to not publish the Petition for the review and comment of all interested parties.

Our members generally support the requirements of the rulemaking. However, as
indicated in the attached comments, the cost analysis contained in the rule significantly underestimates the actual cost of the replacement doors. Timing is also a significant issue both from the lapsed time required to accomplish the modifications as well as the time remaining to accomplish the retrofit within the final deadline. From an industry perspective, we support these observations and recommend that the rule be modified as necessary to take these issues into account.By: ATA, Charlie Bautz
