Re: Denial of Exemption

By letter filed April 8, 2003, you petitioned the Federal Aviation Administration (FAA) on behalf of Euroatlantic for an exemption from § 129.28 of Title 14, Code of Federal Regulations (14 CFR). The proposed exemption, if granted, would permit Euroatlantic to operate one Lockheed L-1011 aircraft after April 9, 2003, without meeting the requirements of §129.28 (c). You asked for an exemption until September 2003.

Comments of ComAir to Application of Spirit Airlines

The FAA must either (i) engage in a comparative selection process to evaluate the merits of the respective service proposals; see, Ashbacker Radio Corp. v. FCC, the permanent slot pool and allocate the service opportunities by established lottery procedures.

Comair' s service will dramatically cut travel time on the DCA-Lexington and DCA-Savannah routes, saving travelers at least an hour in each direction and reducing round-trip elapsed travel times by up to fifty percent. No similar service benefits can be attributed to Spirit's proposal, since both the DCA-Detroit and DCA-Ft. Lauderdale routes already have nonstop service and would experience no time savings.
