Complaint

On or about October 25, 1996, two Special Agents of the FAA conducted a test of Security Directive compliance of Respondent at the Memphis International Airport (MEM), Memphis, Tennessee. During the test, the Special Agents presented themselves to Northwest employee Rick Polasck as ticketed passengers for Northwest flight number 822 from MEM to Atlanta, Georgia. During the above test, Mr. Polasck failed to ask the Agents if they were carrying any items given to them by unknown persons or if their bags had been out of their immediate control since the time they were packed.

Re: In the Matter of Case No. 97NE030021

On July 14, 1997, Northwest Airlines, Inc., was advised through a Notice of Proposed Civil Penalty that the FAA proposed to assess a civil penalty in the amount of $ 10,000. On or about January 25, 1997, Northwest Flight #242, a DC-9-32, civil aircraft N983US operating in scheduled interstate air transportation, was struck in its tail section by a de-icing truck performing de-icing operations at Bradley International Airport, Windsor Locks, Connecticut.The driver of the truck referenced in paragraph 4, above, was not in communications with the bucket operator during said incident.

As a result of the foregoing facts and circumstances Northwest Airlines, Inc. violated Section 121.3(a), of the Federal Aviation Regulations in that Northwest engaged in scheduled interstate air transportation within the 48 contiguous states or the District of Columbia in violation of a domestic air carrier operating certificate and appropriate operations specifications issued under this part.
