The petitioner states that it has a fleet consisting of one Stage 3 Boeing 737-200 and two Stage 2 Boeing 727-200 airplanes. The petitioner is requesting an emergency exemption pursuant to § 11-27(j) because its only Stage 3 airplane was severely damaged from a tornado on February 2, 1998, at Miami International Airport, Miami, Florida. Without its Stage 3 airplane, Nations Air may only operate one Stage 2 airplane to remain in compliance with § 91.867.

It is alleged that Nations Air Express, Inc. violated Section 121.433(a) of the Federal Aviation Regulations in that NAE used a person as a required crewmember without that person having satisfactorily completed, in a training program approved under subpart N of this part, initial ground and flight training for that type airplane and for the particular crewmember position. Pursuant to 49 USC Section 46301(a), Nations Air Express, Inc., is subject to a civil penalty not to exceed $11,000 for each of the violations alleged. Under the facts and circumstances of this case a civil penalty of $3,000 is appropriate.
