Petition for Exemption to FAR 125.1 (b) (2)
In recognition of the "special" nature of our mission The US Department of State (Office of Defense Controls) has granted preliminary permission for Charity Airlift to operate a Lockheed C-130K for Humanitarian Operation.
Because Charity Airlift is non-profit and solely dependent on donations from private and corporate benefactors we considered that a Restricted Type Certificate would suffice for our humanitarian operations. After discussion with the FISDO at Winston-Salem we believed that operation under Part 91 of FAR's would meet our needs.
However, Reference B would appear to preclude the carriage of persons other than the flight crew even if they were in direct support of a "special" humanitarian operation.
We anticipate that much of our work will involve the carriage of cargo. But it is conceivable that, in order to provide a proficient life-sustaining function, we may wish to carry Charity Airlift ground support personnel, aid workers from other charities or, in the case of a life threatening situation, refugees or medical evacuees. If we are unable to carry "operational passengers" our service to charities and, on occasion, evacuees will be severely impaired.
Charity Airlift therefore seeks exemption from Reference A to operate with a Restricted Type Certificate under Part 125 of FAR's.
