ATA requests an exemption from 14 C.F.R. ~ 121.310(m) to operate five (5) Lockheed L-1011-385-3 (also known as L-1011-500) aircraft in the United States without conforming to the 60-foot required distance between emergency exits. ~ These aircraft, which bear serial numbers 293A- 1217, 293A- 1219? 293A- 1220, 293A- 1239 and 293A-1238 (the "Aircraft"), are owned and presently being operated by Royal Jordanian Airlines. ATA is filing this Petition at this time because it is involved in serious discussions over the possible purchase of these Aircraft.

On or about October 18, 1996, an American Trans Air, Inc. Daily Service Check (required by its Maintenance Program Manual) was due to be performed on a Boeing 757-208 aircraft, identification number N755AT. American Trans Air, Inc. operated the aircraft described above onfour flights before performing the Daily Service Check on October 20, 1996 (due October 18). Until the inspection described above was performed, theairworthiness of the aircraft desribed above was indeterminable. As a result, American Trans Air, Inc. operated the aircraft describedabove when that aircraft was not in an airworthy condition and didnot meet applicable airworthiness requirements, including thoserelating to identification and equipment.
