OST-95-849 / American Airlines (renewal of U.S.-Brazil frequency allocation) / November 26, 1997
Application of
AMERICAN AIRLINES, INC.
for renewal of U.S.-Brazil frequency allocation
APPLICATION OF AMERICAN AIRLINES, INC. FOR RENEWAL OF
U.S.-BRAZIL FREQUENCY ALLOCATION
American Airlines, Inc. hereby applies for renewal of its allocation of three weekly U.S.-Brazil frequencies, initially granted by Order 95-1-27, January 20, 1995 and renewed by Order 96-3-17, March 14, 1996. American uses these three frequencies (together with four additional frequencies allocated by separate order l/) to provide daily nonstop service between Dallas/Ft. Worth and Sao Paolo.
In filing this application, American invokes the automatic extension provisions of the Administrative Procedure Act, 5 USC 558(c), as implemented by 14 CFR Part 377. The allocation would expire on February 2, 1998, absent this renewal application. This application is timely under Section
1/ The four frequencies were granted on a pendente lite basis by Notice of Action Taken, June 16, 1995 (Docket 50391); and made final by Order 95-10-25, October 17, 1995.
2
377.10(c) since it is filed more than 60 days in advance of the expiration date.
Renewal of the subject exemption is consistent with the public interest. American has been operating daily nonstop service between Dallas/Ft. Worth and Sao Paolo since April 1, 1995, providing substantial public benefits in the local market as well as in scores of beyond markets served through American's Dallas/Ft. Worth hub. For the reasons cited in American's initial application of November 14, 1994 (undocketed) for allocation of U.S.-Brazil frequencies to serve the Dallas/Ft. Worth-Sao Paolo market, which is incorporated herein by reference, American's allocation should be renewed for a period of at least two years.
Respectfully submitted,
