ORDER
Pursuant to section 49 U.S.C. §44907, on October 20, 1997, I notified the Government of Haiti that I had determined that Port-au-Prince International Airport (PAP), Port-au-Prince, Haiti, did not maintain and carry out effective security measures. On January 19,1998, 90 days elapsed since my determination, and I have found that Port-au-Prince International Airport still does not maintain and carry out effective security measures. This determination is based on Federal Aviation Administration assessments which reveal that security measures used at the airport do not meet the standards established by the International Civil Aviation Organization.
49 U.S.C. §44907 d(1) requires all U.S. air carriers and foreign air carriers providing service between the United States and PAP to provide notice of my determination to any passenger purchasing a ticket after the effective date of this order for transportation between the United States and PAP, with such notice to be made by written material included on or with such ticket. Of course, agents of such U.S. and foreign air carrier issuing U.S.-Port-au-Prince tickets are also required to provide this notice. However, if an agent fails to do so, a carrier may carry the passenger if it provides the notice prior to boarding.
The Department has decided that the following language, if provided to passengers in written material to be included on or with any U.S. - Port-au-Prince ticket they may purchase, will meet the obligation to provide notice.
The United States Secretary of Transportation has determined that Port-au-Prince International Airport, Port-au-Prince, Haiti, does not maintain and carry out effective airport security measures.
This model language is provided solely for the guidance of carriers and their agents and does not bind them in any way. Carriers are also free to provide such additional information as they desire.
ACCORDINGLY:
1. The U.S. and foreign air carriers named on the attached service list providing service between the United States and PAP, Port-au-Prince, Haiti, are notified of their obligation under section 49 U.S.C. §44907 to provide to any passenger purchasing a U.S.-Port-au-Prince ticket after the effective date of this order, written notice of my determination that Port-au-Prince International Airport, Port-au-Prince, Haiti, does not maintain and carry out effective security measures;
2. This order shall be effective on January 23, 1998;
3. Copies of this order shall be served on the carriers and associations on the attached service list.
