Applications for Statements of Authorization and Exemption

The Applicants request authority to provide valuable U.S.-Denmark/Norway/Sweden and third country codeshare services which will serve the public interest. Continental and SAS codeshare service will expand airline competition on international routes to benefit passengers and shippers and expand the Continental and SAS networks.

Continental and SAS seek statements of authorization permitting Continental to display the SK* code on Continental flights and permitting SAS to display the CO* code on SAS flights in conjunction with foreign air transportation of persons, property, and mail: (i) between any point or points in the United States and any point or points in a Member State of the European Union or Norway (on a nonstop basis and on routings via intermediate open skies points); (ii) between any point or points in the United States and any other point or points in the European Common Aviation Area and Switzerland where an open skies agreement is being applied; (iii) between U.S. points; (iv) between EU points; (v) between points in Norway; (vi) between points in the EU and points in Norway; (vii) between the EU or Norway, and any open-skies point or points; and, (viii) beyond the EU or Norway to any point or points; and (xi) beyond the U.S. to any point or points.

Continental requires supplemental exemption authority to implement the proposed codeshare agreement and maximize its flexibility to provide global, codeshare service by placing its code on SAS flights serving points for which Continental does not otherwise hold authority. Thus, Continental requests exemption authority to provide codeshare service at points served by SAS which are neither in open skies countries nor listed in Continental's certificate or exemption authority upon 30 days' notification to the Department, as Continental has been allowed to do with other carriers.

We have polled the carriers on the service list for the above-referenced application and have received non-objections from all US carriers served. Prompt approval of the application is requested so that Continental and SAS can begin marketing and advance sales of the codeshare services as soon as possible.

Notice of Action Taken

Amendment for scheduled foreign air transportation of persons, property, and mail between points in the United States and points worldwide on a third-country code-share basis pursuant to blanket codesharing statements of authorization previously approved by the Department.

Blanket statements of authorization to permit Continental to display the (SK*) designator code of SAS on Continental flights and SAS to display the (CO*) designator code of Continental on SAS flights in conjunction with foreign air transportation of persons, property, and mail on flights: 1) between any point or points in the United States and any point or points in any European Union Member State or Norway (either nonstop or via intermediate Open Skies points); 2) between any point or points in the U.S. and any other point or points in the European Common Aviation Area where an Open Skies agreement is being applied; 3) between US points; 4) between EU points; 5) between points in Norway; 6) between points in the EU and points in Norway; 7) between the EU or Norway, and any Open Skies point or points; 8) beyond the EU or Norway to any point or points; and 9) beyond the US to any point or points.
