Application for an Exemption - Bookmarked

Shanghai Airlines Co., Ltd. hereby applies for a new or amended exemption from 49 U.S.C. § 41301 authorizing Shanghai Airlines to engage in charter foreign air transportation of persons, property, and mail between the People's Republic of China and the United States, and other charters pursuant to 14 C.F.R. Part 212, using the Company's own aircraft. Shanghai Airlines seeks approval of such exemption authority for a period of at least one year.

Initially, Shanghai Airlines plans to rely on the requested exemption authority and a statement of authorization under Part 212 to conduct a series of twice-weekly charter flights during the month of September between Shanghai and Saipan, Commonwealth of the Northern Mariana Islands, commencing on or about September 4, 2008. The Company plans to provide this charter service using B767-300ER airplanes from its fleet configured with 28 business class seats and 200 economy seats.

Notice of Action Taken

Exemption from 49 USC §41301 to permit the applicant to engage in charter foreign air transportation of persons, property, and mail between the People’s Republic of China and the United States, and other charters pursuant to 14 CFR Part 212 of the Department’s regulations, using the company’s own aircraft.

Shanghai Airlines holds existing exemption authority to permit it to engage in certain scheduled and charter operations subject to the limitation that all of those services are provided pursuant to code-share or wet lease operations as indicated. (See Notice of Action Taken dated May 4, 2007, in Docket DOT-OST-2006-24169).

We note that the applicant’s exemption authority to operate scheduled combination U.S.-China passenger service remains limited to operations conducted pursuant to its codeshare arrangement with United Air Lines, Inc., and its exemption authority to operate scheduled U.S.-China all-cargo service remains limited to operations conducted using aircraft wet leased from a duly authorized and properly supervised U.S. or foreign air carrier
