Avjet Corporation OST-2008-0224 - Certificate of Public Convenience - Interstate and Foreign Charter Passenger July 15, 2008 Application for a Certificate of Public Convenience and Necessity - Bookmarked - Link has been Corrected Avjet Corporation plans to add a Boeing Business Jet in VIP configuration for 19 passengers to its FAR-135 on demand single entity charter service. Potential customers have been identified as a result of the services which Avjet now provides with smaller jets, and therefore, Avjet does not anticipate a need to conduct marketing for the limited charter operation of this aircraft. Southern California and the Los Angeles area probably have the greatest demand for jet charter services of any U.S. market. Avjet believes that word of mouth on the availability of a BBJ will produce the limited number of charter hours desired. This will be one of the few BBJs available for charter in Southern California. The aircraft that Avjet will use for its services is owned by Shangri La Entertainment, LLC, an unrelated U.S. company which already uses its aircraft under Avjet's management for FAR Part 91 flights. Avjet will lease the aircraft on an hourly basis from Shangri La. Avjet will not be required to make lease payments for positioning, training or maintenance flights. This will ensure that Avjet will not incur any aircraft expense unless it has charter business to cover such expenses. In addition, Shangri La will pay storage for the aircraft leased to Avjet. As a result, the vast majority of Avjet's expenses will be incurred only when it is operating revenue flights for third party customers. Avjet is currently making plans to add a second BBJ aircraft to its proposed operation, therefore it asks the Department to grant it authority for three aircraft to permit modest growth as justified by the market, subject to similar arrangements between Avjet and Shangri La or another lessor.The significant experience of Avjet's key personnel demonstrates that Avjet is fit, willing and able to support the proposed. In the event that Avjet requires additional crew to operate a flight due to the illness, vacations or flight and duty time restrictions of Avjet's BBJ pilots, Avjet will contract with fully qualified pilot service companies on a daily basis. OST-2008-0224 - Certificate of Public Convenience - Interstate and Foreign Charter Passenger September 16, 2008 Re: Additional Information - Bookmarked Pursuant to your letter and request regarding the need for additional information and/or clarifying information for further processing our application [Dockets OST-2008-0224 and OST-2008-0231], Avjet submits updated information required before the interstate and foreign charter certificates issued by those orders can be made effective, which has been filed electronically today in Dockets OST-2008-0224 and OST-2008-0231. Additionally, per your Information Request of September 5, 2008, we have 1) filed Avjet's Aircraft Accident Response Plan in Docket OST-1996-1960 and have forwarded a copy to the National Transportation Safety Board, 2) filed Avjet's signed counterpart of Agreement 18900, waiving certain passenger liability limits and certain air carrier defenses under the Warsaw Convention, in Docket OST-1995-236 and 3) filed Avjet's statement summarizing its method of collection of passenger manifest information and transmission to Department of State in the event of an aviation disaster on a covered international flight segment in Docket OST-1998-3305.
