Application for an Exemption

By this application, USA 3000 seeks an exemption from 49 US.C. §41101 to engage in scheduled foreign air transportation of persons, property and mail between the US. and Mexico as more fully described in Exhibits USA3K-100-101 herein. USA 3000 plans to begin service to Mexico on these routes on or about June 8, 2008, or as soon thereafter as all necessary Mexican licenses have been obtained. USA 3000 intends to operate these services with its growing fleet of new, state-of-the-art, Airbus A-320 (168Y) aircraft.

It is USA 3000's understanding that incumbent ATA recently announced that it was going to be ceasing all Chicago (MDW)-Cancun service effective June 7, 2008, and it is USA 3000's further understanding that ATA in fact ceased all airline operations last week. Therefore, based on ATA's announcement and its cessation of operations, it is USA 3000's understanding that this designation on the Chicago-Cancun city-pair is now immediately available to a U.S. carrier.

Notice of Action Taken

Scheduled foreign air transportation of persons, property, and mail between Chicago, Illinois, and Cancun, Mexico.

The U.S.-Mexico exemption authority granted is subject to the dormancy notice requirements set forth in condition 7 of Appendix A of Order 1988-10-2. Consistent with our standard policy, the dormancy notice period will begin on June 8, 2008, the carrier’s proposed start-up dates for the subject services.
