Aeroenlaces Nacionales, S.A. de C.V. d/b/a vivaAerobus OST-2008-0095 - Exemption - Mexico-US March 10, 2008 vivaAerobus, a Mexican air carrier, respectfully applies for an exemption from provisions of 49 U.S.C. § 41301, authorizing it to engage in scheduled foreign air transport of persons, property and mail between (1) Monterrey, Mexico and Gary, Indiana; (2) Monterrey, Mexico and Las Vegas, Nevada; (3) Veracruz, Mexico and Austin, Texas; and (4) Puerto Vallarta, Mexico and Austin, Texas. vivaAerobus plans to institute this service during the first week of July 2008. vivaAerobus will poll other carriers and report the results to the Department. vivaAerobus requests that the Department grant this exemption for a two-year period. vivaAerobus proposes to offer: (1) daily nonstop round trip service between Monterrey and Gary, Indiana and Las Vegas, Nevada; (2) nonstop round trip service between Veracruz and Austin, Texas three times per week; and (3) nonstop round trip service between Puerto Vallarta and Austin, Texas four times per week. vivaAerobus plans to use Boeing 737-300 aircraft on its proposed routes. vivaAerobus holds a foreign air carrier permit, see Order 2008-1-23, to operate scheduled foreign air transportation of persons. property, and mail between the Mexican points of Monterrey, Guadalajara, Puebla, Leon, Queretaro, and Cancun and Austin, Texas; and to operate charter foreign air transportation of persons, property. and mail between Mexico and the U.S. Counsel: Kirstein & Young, David Kirstein, 202-331-3348
