Order Granting Renewed and Amended Exemption and to Show Cause

By applications filed April 25, 2006, as amended September 11, 2006, December 22, 2006, and November 13, 2007, in the referenced Dockets, Yangtze River requests (1) renewal of its current exemption authority, which authorizes the carrier to engage in scheduled foreign air transportation of property and mail between Shanghai, People’s Republic of China, and the coterminal points Anchorage, Alaska; Boston, Massachusetts; Los Angeles, California; and New York, New York, (2) amendment of that exemption authority to allow the carrier to conduct these services using its own aircraft and crews, and (3) an initial foreign air carrier permit to conduct these services. Yangtze River’s current exemption authority contains a condition that the carrier “may not conduct U.S. operations with its own aircraft and crews without further action by the Department.”

By this order we grant the application of Yangtze River Express Airlines Co., Ltd. for a renewed and amended exemption, under 49 U.S.C. §40109. We also tentatively find that it is in the public interest to grant the applicant the foreign air carrier permit.

Our action granting the exemption authority described herein is effective immediately, for a period of one year from the issue date of this order, or until the attached permit becomes effective, whichever is earlier.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
