Application for a Foreign Air Carrier Permit - Bookmarked

SAT Airlines is a rapidly growing airline in the Russian Far East. It operates passenger and cargo services in the region and on international routes. It primarily specializes in providing connections between remote locations in the region. SAT Airlines is using its AN-24 aircraft to operate services to such domestic destinations with difficult access as the points in the Kuril Islands and Northern Sakhalin, as well as internationally for flights to Sapporo and Hakodate, Japan. SAT also uses Boeing 737-200 equipment for its flights to the Republic of Korea and Japan and China.

SAT Airlines plans to operate with the frequency of one flight a week between Vladivostok, Yuzhno-Sakhalinsk, Petropavlovsk-Kamchatsky and Anchorage, and carry approximately 5,000-8,000 passengers and 15.6-20 tons of cargo annually between those destinations, with the annual profit of approximately US $ 500,000. SAT Airlines will utilize Boeing -737-200 aircraft for its proposed U.S. operations.

  1. The Declaration of Konstantin P. Sukhorebrik, General Director of SAT Airlines, certifying the true and correct character of the factual statements set forth in the Application and its exhibits.
  2. The Waiver of Liability Limits Under Warsaw/Montreal Convention as required by 14 C.F.R. § 211.20(t), as part of Exhibit SAT-18.

Order Granting Exemption and to Show Cause

We exempt Joint Stock Company “Sakhalinskie Aviatrassy” Airlines d/b/a SAT Airlines or SAT from the provisions of 49 U.S.C. §41301 to the extent necessary to permit it to engage in: 1) scheduled foreign air transportation of persons, property and mail between the Russian points Vladivostok, Yuzhno-Sakhalinsk, Petropavlovsk-Kamchatsky, and Anadyr, on the one hand, via intermediate points, and Anchorage, Alaska, on the other hand; and 2) charter foreign air transportation of persons, property and mail between any point or points in the Russian Federation and any point or points in the United States, and other charter operations in accordance with 14 CFR Part 212.

We grant the request of Joint Stock Company “Sakhalinskie Aviatrassy” Airlines d/b/a SAT Airlines or SAT for confidential treatment of its financial submissions, consistent with the provisions of 14 CFR §302.12.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

Final Order

By Order 2007-11-2, issued November 2, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 U.S.C. §41307) which will make final the findings and conclusions of the
Order.

No objections were received within the time period provided.
