Application for Exemptions

Delta has requested that Shuttle America operate 70-seat ERJ-170 aircraft on year-round service between Atlanta, Georgia, and Queretaro and Monterrey, Mexico, commencing on or about January 14, 2008, and March 3, 2008, respectively. Shuttle America will be introducing the very first Delta Connection service on the Atlanta-Queretaro route. Both Shuttle America and Delta Connection carrier Atlantic Southeast Airlines will operate year-round service on the Atlanta-Monterrey route.

Currently, two U.S. carriers may be designated to operate services on each of these routes, and a third designation will become available for the Monterrey route effective October 26, 2007. No other carrier is designated for the Atlanta Queretaro route, and only ASA is designated for the Atlanta-Monterrey route. Thus, when the proposed service begins in January 2008, one designation will remain available for U.S. carriers to operate on each of these routes even after granting the requested U.S.-Mexico authority to Shuttle America.

Joint Response to Notice

Delta Air Lines, Inc. and Shuttle America Corporation submit this brief Response out of an abundance of caution to point out that they have a pending Joint Application in this Docket to serve the Atlanta-Monterrey market. For the reasons set forth in that Joint Application, which is incorporated by reference herein, the Department should grant the Atlanta-Monterrey authority and designations requested therein.

Only one of the two current designations for the Atlanta-Monterrey route is presently allocated (to Atlantic Southeast Airlines, Inc.), and, in any event, an additional designation will become available for all U.S. point-Monterrey routes next month, including for the Atlanta-Monterrey route. Thus, when the proposed Atlanta-Monterrey service begins in March 2008, one designation will remain available for U.S. carriers to operate on each of these routes even after granting the requested U.S.-Mexico authority to Shuttle America. In fact, the pending Joint Application for Atlanta-Monterrey authority is noncontroversial, as evidenced by the lack of objections received in response to the Joint Applicants' polling last month. Notice of Action Taken

Exemption for Delta and Shuttle America for two years: Scheduled foreign air transportation of persons, property, and mail between Atlanta, Georgia, and Queretaro, Mexico.

Exemption for Shuttle America for two years: Scheduled foreign air transportation of persons, property, and mail between Atlanta, Georgia, and Monterrey, Mexico.

Delta already holds exemption authority to serve the Atlanta-Monterrey market (See Route 562, Order 2000-5-31). On September 21, 2007, Delta and Shuttle filed a joint response in the present docket recognizing that a Notice had been issued by the Department (dated September 12, 2007, undocketed), inviting U.S. carriers to file for soon-to-be-available authority between any U.S. point, on the one hand, and Monterrey and Guadalajara, Mexico, on the other hand. In their response to this Notice, the joint applicants urged the Department to proceed with the captioned application (including the request to serve Monterrey), as the authority requested is available now under the aviation agreement, and is non-controversial.

The joint applicants further request that Shuttle be authorized to integrate this authority with its other exemption and certificate authority to the extent permitted by international agreements. The joint applicants state that they will use the subject authority under a code-share fee-for-service arrangement with Delta, whereby Shuttle will operate 70-seat Embraer 170 aircraft on behalf of, and under the trade name of, Delta.

Re: Dormancy Notices

"Delta Connection" services operated by Shuttle America Corporation pursuant to a codeshare fee-for-service arrangement with Delta Air Lines, Inc., on the two U.S.-Mexico routes identified below are ceasing next month. Shuttle America's designations for these routes may be considered dormant as of the dates noted:

  • Atlanta-Leon/Guanajuato (ATL-BJX) (to be discontinued eff. Aug. 18, 2008)
  • Atlanta-Queretaro (ATL-QRO) (to be discontinued eff. Aug. 2, 2008)
