Application for a Foreign Air Carrier Permit - 28 MB

vivaAerobus, a Mexican air carrier, respectfully applies for a foreign air carrier permit, authorizing it to engage in scheduled foreign air transport of persons, property and mail from a point or points in Mexico to a point or points in the United States, as well as such charter authority permitted under the US.-Mexico Air Transport Agreement and 14 C.F.R. Part 212.

vivaAerobus will operate non-stop daily services on the following routes commencing the first week of November 2007:

  1. Monterrey, N.L. - Austin, Texas
  2. Guadalajara, Jal. - Austin, Texas
  3. Pueblaa, Pue. - Austin, Texas
  4. Leon, Gto. - Austin, Texas
  5. Queretaro, Qet. - Austin, Texas
  6. Cancun, Q. Roo - Austin, Texas

On November 30, 2006, vivaAerobus was organized under the Mexican law of Sociedad Anonima as the first low-cost Mexican air carrier. The Company is approximately 75% owned by a subsidiary of the Mexican bus transportation company, Inversionistas en Autotransportes Mexicanos SA de CV and approximately 25% owned by the RyanMex Group. As the biggest passenger bus transportation operator in Mexico, IAMSA serves 20 of the 31 Mexican states, transporting 260 million passengers annually with 9000 buses and 389 stations. RyanMex is controlled by the Ryan family, which holds shares in Ryanair, Singapore's Tiger Airways and a U.S. carrier, Allegiant. The Company started operations with an initial investment of $50 million and two Boeing 737-300 airplanes. The Government of Mexico granted authority to vivaAerobus to operate passenger and cargo services. With its hub at Mariano Escobedo International Airport in Monterrey, Mexico, vivaAerobus serves several Mexican cities. Presently, vivaAerobus operates a fleet of five Boeing 737-300 aircraft.

Re: Ownership Information

This is to follow up on your request regarding the citizenship of the owners of ownership of Inversionistas en Autotransportes Mexicanos, SA de CV, which owns 75.03% of vivaAerobus through a wholly owned subsidiary OmniAir, S.A. de C.V. There are 841 individual shareholders, all of whom are citizens of Mexico. Except for the two shareholders whose names were previously provided in the applications, no IAMSA shareholder holds more than 5% of that company's voting shares.

Order Granting Exemption and to Show Cause

We grant the request of Aeroenlaces Nacionales, S.A. de C.V. d/b/a vivaAerobus for an exemption under 49 U.S.C. §40109 to permit it to engage in: 1) scheduled foreign air transportation of persons, property, and mail between the Mexican points of Monterrey, Guadalajara, Puebla, Leon, Queretaro, and Cancun, on the one hand, and Austin, Texas, on the other hand; and 2) charter foreign air transportation of persons, property, and mail between Mexico and the United States, and other charter operations in accordance with 14 CFR Part 212.

Our action granting the exemption authority described herein is effective immediately, for a period of one year from the issue date of this order, or until the attached permit becomes effective, whichever is earlier.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department

By Order 2007-11-3, issued November 3, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto.  We gave interested persons 21 days to file objections to the Order.  We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.
