Motion to Withhold Information from Public Disclosure

Hi Fly hereby submits this Application for an initial foreign air carrier permit to provide charter foreign air transportation of persons, property and mail from points behind Portugal via Portugal and intermediate points to a point or points in the United States and beyond. Concurrent with the filing of this application, Hi Fly is applying for corresponding exemption authority.

Hi Fly proposes to commence charter combination service on or about October 1, 2007 between multiple points in the United States on the one hand, and Lisbon, Oporto, Funchal-Madeira Islands and Ponta Delgada-Azores Islands in Portugal on the other. As it is currently planned, Hi Fly intends to operate non-stop or multi-stop flights on a charter basis. The proposed service will be operated using Airbus A330 aircraft configured to carry 42 business class and 236 economy class passengers. Hi Fly will supplement this Application with the specifics of its charter service in the near future. Hi Fly will operate an Airbus A330-322. The A330 will be used exclusively by Hi Fly.

Order Granting Exemption and To Show Cause | Word

We grant the request of Hi Fly for an exemption under 49 U.S.C. § 40109 to permit it (1) effective on the issue date of this order, to accept payment, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, for the services: a) Foreign charter air transportation of persons and property from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) Foreign charter air transportation of persons and property between any point or points in any member of the European Common Aviation Area and any point or points in the United States; c) Other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department’s regulations; and d) Charter transportation authorized by any additional route rights available to European Community carriers in the future.

We grant the motion of Hi Fly for confidential treatment of its financial submissions.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
