Regional Compagnie Aerienne Europeenne and Northwest Airlines, Inc. OST-2007-28643 - Exemption and Statement of Authorization - Intra-Europe Codesharing June 28, 2007 Joint Application for Exemption and Statement of Authorization and Motion to Consolidate The "Joint Applicants" request a blanket statement of authorization under 14 C.F.R. Part 212, to the extent necessary so that Regional can engage in codeshare operations with Northwest over the intra-European city-pair segments on which Regional operates flights for Societe Air France. It is requested that the blanket statement of authorization remain in effect for a period of unlimited duration (subject to the Department's usual conditions) and that the exemption issued to Regional by the Department pursuant to this Application remain in effect for a period of at least two years. Regional intends to commence codeshare operations with Northwest on or about September 1, 2007, and the Joint Applicants request prompt approval so that the marketing and sale of these codeshare flights can begin as soon as possible. The applicants also request that this codesharing authority be administered with the existing Northwest/Air France statement of authorization in Docket OST-2004-19214, and that any future code-share notice given for Air France or Régional be deemed as notice given for either carrier (see Notice of Action Taken August 2, 2002 in Docket OST-2001-10354). OST-2007-0107 - Exemption and Statement of Authorization - Blanket Codesharing March 11, 2008 Application to Modify Statements of Authorization In the applications for the statements of authorization granted, Northwest and the Air France Regionals requested, for administrative purposes, that these codeshare authorizations be consolidated into Docket OST-2004-19214, the Docket established by the Department for the administration of the grant of blanket statements of authorization to engage in reciprocal codesharing issued to Northwest and Air France, and that future codeshare notices for one Air France Regional be deemed notice filed by Air France and other Air France Regionals as well. Although both NOATs recite the request for consolidation as part of the relief requested and indicate "approval," the applicants' specific requests for relief such that "any future code-share notice given for Air France [or an Air France regional carrier] be deemed as notice given for either carrier" were either overlooked or never expressly granted. See NOAT dated March 4, 2008, Docket OST-2007-28643. Therefore, Northwest and the Air France Regionals request that the following footnote, substituting the Air France Regional carrier names where appropriate, be added to the codeshare conditions included in each of the NOATs cited above:
As a result of the Department's footnote, it is clear in the case of Northwest and the Northwest Airlink Carriers that a codeshare notice for one Northwest carrier will be deemed as notice for all the other Northwest carriers. Thus, similar treatment should be granted in connection with the Northwest/Regional and Northwest/Brit Air/CityJet statements of authorization, and the NOATs dated February 25 and March 4, 2008 should be modified with the addition of the footnote text identified in italics above.
