Frontier Airlines, Inc. OST-2007-28519 - Exemption - Albuquerque-Puerto Vallarta June 13, 2007 Frontier hereby applies for an exemption authorizing Frontier to engage in scheduled foreign air transportation of persons, property, and mail between Albuquerque, New Mexico, and Puerto Vallarta, Mexico. Frontier requests that it be designated for this route under the U.S.-Mexico Air Transport Agreement, as amended. Grant of Frontier's application is consistent with the Department's mandates and goals to place maximum reliance on competitive market forces and to encourage entry into markets. This service will be operated by Republic Airlines, Inc.under a code-share arrangement with Frontier. Frontier currently code-shares with Republic on other Mexico routes. Frontier requests that the Department promptly grant the requested exemption authority for a period of two years, or until 90 days after issuance of corresponding certificate authority, whichever occurs earlier. June 18, 2007 We have polled the US carrier representatives served with the above-referenced application, and no carrier has objected to Frontier's request for an exemption. Filed June 13, 2007 | Issued June 22, 2007 Scheduled foreign air transportation of persons, property, and mail between Albuquerque, New Mexico, and Puerto Vallarta, Mexico, and to integrate this authority with its other exemption and certificate authority to the extent permitted by international agreements. While Frontier stated in its application that the subject service will be operated by Republic Airlines, Inc. under a code-share arrangement with Frontier, Frontier's counsel informally clarified that Frontier will, in fact, serve the market pursuant to a fee-for-service arrangement with Republic, rather than a code-share. June 22, 2007 Re: Notice of Service Starting Date On June 13, 2007, Frontier Airlines, Inc., applied for an exemption authorizing Frontier to engage in scheduled foreign air transportation of persons, property, and mail between Albuquerque, New Mexico, and Puerto Vallarta, Mexico. This service will be operated by Republic Airlines, hie. under a code-share arrangement with Frontier. On June 22, 2007, the Department issued a Notice of Action Taken (Docket OST-2007-28519) granting the requested authority to Frontier. Please be advised that the service will begin on December 15th by Republic and will be operated with Embraer - 170 aircraft seating 76 people.
