OST-2007-28519 - Exemption - Albuquerque-Puerto Vallarta

June 13, 2007

Application for an Exemption

Frontier hereby applies for an exemption authorizing Frontier to engage in scheduled foreign air transportation of persons, property, and mail between Albuquerque, New Mexico, and Puerto Vallarta, Mexico.

Frontier requests that it be designated for this route under the U.S.-Mexico Air Transport Agreement, as amended. Grant of Frontier's application is consistent with the Department's mandates and goals to place maximum reliance on competitive market forces and to encourage entry into markets.

This service will be operated by Republic Airlines, Inc.under a code-share arrangement with Frontier. Frontier currently code-shares with Republic on other Mexico routes.

Frontier requests that the Department promptly grant the requested exemption authority for a period of two years, or until 90 days after issuance of corresponding certificate authority, whichever occurs earlier.

Re: Polling Results

We have polled the US carrier representatives served with the above-referenced application, and no carrier has objected to Frontier's request for an exemption. Frontier asks that the Department grant the exemption authority as soon as possible.

Notice of Action Taken

Scheduled foreign air transportation of persons, property, and mail between Albuquerque, New Mexico, and Puerto Vallarta, Mexico, and to integrate this authority with its other exemption and certificate authority to the extent permitted by international agreements.

While Frontier stated in its application that the subject service will be operated by Republic Airlines, Inc. under a code-share arrangement with Frontier, Frontier's counsel informally clarified that Frontier will, in fact, serve the market pursuant to a fee-for-service arrangement with Republic, rather than a code-share.

By Order 2006-1-1, the Department awarded the carrier a blanket route integration certificate.
