OST-2007-28272 - Exemption and Statement of Authorization - Seattle-Mexico City

May 16, 2007

Joint Application for Exemption and Statement of Authorization

The Joint Applicants request the issuance of the following authorities:

  1. an exemption to Delta, pursuant to 49 U.S.C. 40109, authorizing Delta to engage in scheduled foreign air transportation of persons, property and mail between Seattle, Washington, and Mexico City, Mexico; and
  2. a statement of authorization to Aeromexico, pursuant to 14 C.F.R. Part 212, to permit Aeromexico to display Delta's "DL" designator code on flights operated by Aeromexico between Seattle, Washington, and Mexico City, Mexico.

The Joint Applicants plan to introduce the proposed Seattle-Mexico City codeshare services on or about July 4, 2007, and request that the exemption and statement of authorization be granted as soon as possible so that Delta is able to market and sell nonstop Seattle-Mexico City service without delay. Delta requests that its exemption authority be effective for a period of at least two years, or until 90 days after it is granted certificate authority for this route, whichever occurs earlier. The Joint Applicants request that the codesharing statement of authorization remain in effect indefinitely, consistent with the duration of the U.S.-Mexico codeshare authorities granted by DOT Order 1999-6-6.
