Application for an Exemption from 49 USC 41301

By this application, Aeromexico seeks an exemption to engage in scheduled foreign air transportation of persons, property and mail on the ten Mexico-U.S. transborder routes listed in the Attachment. On or about July 1, 2007, Aeromexico proposes to offer nonstop round trip service in each market, as described in the Attachment, utilizing B-737-700 or MD-87 aircraft. The proposed nonstop services will generate significant benefits for the traveling and shipping public.

Answer of Norman Mineta San Jose International Airport

Aeromexico filed on May 14, 2007, to the Department of Transportation for an exemption from the provisions of 49 U.S.C. 41301 to engage in scheduled foreign air transportation of persons, property, and mail on ten new trans border routes including San Jose-Guadalajara and San Jose-Mexico City.

Norman Y. Mineta San Jose International Airport urges the Department of Transportation to approve the application filed by Aeromexico for these new routes.

At present, SJC has daily service to Guadalajara and less than daily service to Leon and Morelia with Mexicana Airlines. These new flights proposed by Aeromexico will afford our residents and business travelers the option of a second airline in the GDL market, as well as daily service to Mexico City and timely connections to many other cities in Mexico.

Houston welcomes Aeromexico's proposed new services to Mexico, which would be of significant value to travelers and businesses in the Greater Houston area. The new services would expand the options available for passengers destined to and from two key destinations in Mexico, which is Houston's overall largest international market. Houston's flagship airport, George Bush Intercontinental, is the nation's seventh largest international passenger gateway, and is also the top U.S. gateway measured by the number of Mexican destinations served by non-stop scheduled flights and the second-largest U.S. gateway measured by passengers between the U.S. and Mexico. Houston's already strong trade and tourist ties with Mexico would benefit further from the additional Ixtapa/Zihuatanejo and Guadalajara services that Aeromexico plans to provide.

Application for Renewal of an Exemption

Aeromexico, respectfully requests renewal of an exemption granted by Notice of Action Taken, dated June 29, 2007, to the extent necessary to permit Aeromexico to engage in scheduled foreign air transportation of persons, property and mail on the following five Mexico-U.S. transborder routes:

Culiacan-Phoenix
Guadalajara-Houston
Ixtapa/Zihuatanejo-Chicago
Ixtapa/Zihuatenejo-Houston
San Jose del Cabo-New York

Aeromexico does not seek to renew the exemption authority to serve the other five routes approved by the Department in this Docket. The exemption currently is to expire on June 29, 2008. The exemption is requested for one additional year.

Although Aeromexico currently is serving the routes with connecting service, it seeks to renew the nonstop authority so it may provide such service when traffic conditions warrant.

Our June 29, 2007 action also awarded Aeromexico authority to serve the following Mexico-U.S. routes: 1) Puerto Vallarta-Miami; 2) Mexico City-Sacramento; 3) Guadalajara-Oakland; 4) Guadalajara-San Jose; and 5) Mexico City-San Jose. It is not seeking to renew that authority in this application.
