Application for an Exemption

AirBridgeCargo Airlines Limited hereby applies for an exemption from 49 U.S.C. 41302 and such other statutes and the Department's Regulations as may be required, to engage in Boeing 747 all-cargo scheduled and charter operations between the Russian Federation and the United States. ABC intends to start operating the requested services on November 1, 2007, after it takes delivery of its new B747-400ER equipment.

ABC requests that its exemption be granted for a period of one year or until 90 days after the transmission of a final order to the President on ABC's contemporaneously filed application for a foreign air carrier permit, whichever comes first.

In its foreign air carrier permit application ABC is requesting a foreign air carrier permit authorizing it to engage in (1) scheduled all-cargo air transportation operations between any point or points in the Russian Federation, via intermediate points, and points in the United States (Houston, New York and Atlanta), and beyond; and (2) charter all-cargo air transportation operations between any point or points in Russia and any point or points in the United States, as well as any point or points in the United States and any point or points in a third country or countries subject to pertinent national, bilateral and international rules and regulations. ABC will utilize Boeing 747 all-cargo aircraft for its proposed U.S. operations, or such other aircraft as it may have or acquire to conduct the proposed operations.

Answer of the City of Houston and the Greater Houston Partnership

Houston welcomes AirBridgeCargo’s plans to serve Houston, and strongly supports the company’s applications. Although there currently are no scheduled Houston-Russia all-cargo operations, there is a significant need for such service. Indeed, Houston-Russia is already a major cargo market, in large part due to Houston’s preeminent positions in both the U.S. energy and technology industries. In 2006, the air cargo trade between Houston and Russia totaled more than 1.2 million kilograms with a value of more than $84 million, and Russia was Houston’s largest air cargo trade partner in Eastern Europe. Further, Houston plays a major role in the nation’s overall trade with Russia; the total Russia trade handled by the Houston-Galveston Customs District in 2006 had a value of $4.166 billion. This trade is increasing significantly, with a 327% rise being recorded between 2001 and 2006, and a 43% rise between 2005 and 2006. Houston companies have invested heavily in business with Russia, with several being participants in major energy projects underway in Russia. Houston also has a vibrant community of Russian-speakers, and since 2004 has been home to one of only five Russian consulates in the United States, which serves an eight-state region.

The restrictive bilateral agreement between the U.S. and Russia has presented significant challenges for the City in developing the Houston-Russia air service operations that the community needs. AirBridgeCargo’s plans are thus a very welcome addition to the City’s international transportation network.

Amendment to Applications for a Foreign Air Carrier Permit and an Exemption

By this amendment, ABC wishes to amend its Applications by clarifying them as follows: 1) ABC requests a foreign air carder permit authorizing it to engage in (1) scheduled all-cargo air transportation operations between any point or points in the Russian Federation, via intermediate points, and Houston, New York and Atlanta in the United States, and beyond to a point in the Western Hemisphere; and in (2) charter all-cargo air transportation operations between any point or points in Russia and any point or points in the United States, as well as any point or points the United States and any point or points in a third country or countries subject to pertinent national, bilateral and international rules and regulations; 2) ABC intends to operate to the points In the United States stipulated above from Moscow, Russia and Krasnoyarsk, Russia. ABC will notify the Department if these points in the Russian Federation become subject to change. ABC further intends to operate to Toronto, Canada, as its beyond point in the Western Hemisphere, and will notify the Department if this point is changed; and 3) ABC hereby also requests that its application for an exemption pursuant to 49 U.S.C. 41309 filed in Docket OST-2007-28234 contemporaneously with the application for a foreign air carrier permit be amended as stated herein to the extent necessary.

Request to Change Beyond Point in Western Hemisphere

On behalf of AirBridgeCargo Airlines, we hereby notify that ABC would like to request that Toronto be replaced by Montreal as its beyond point in the Western Hemisphere.

ABC therefore requests a foreign air carrier permit authorizing it to engage in (1) scheduled all-cargo air transportation operations between any point or points in the Russian Federation, via intermediate points, and Houston, New York and Atlanta in the United States, and beyond to a point in the Western Hemisphere; and in (2) charter all-cargo air transportation operations between any point or points in Russia and any point or points in the United States, as well as any point or points the United States and any point or points in a third , country or countries subject to pertinent national, bilateral and international rules and regulations

ABC intends to operate to the points In the United States stipulated above from Moscow, Russia and Krasnoyarsk, Russia. ABC will notify the Department if these points in the Russian Federation become subject to any further change. ABC also intends to operate to Montreal, Canada, as its beyond point in the Western Hemisphere, and will notify the Department if this point is further changed.

Houston, Texas; New York, New York; and Atlanta, Georgia, on the other hand, and beyond to a point
or points in the Western Hemisphere; and 2) charter foreign air transportation of property and mail
between any point or points in the Russian Federation and any point or points in the United States, and other charters in accordance with 14 CFR Part 212.
