OST-2007-28129 - Exemption and Foreign Air Carrier Permit - Finland-US Charters May 3, 2007 Application for Exemption and Foreign Air Carrier Permit - Bookmarked Oy Air Finland, a foreign air carrier of Finland, hereby applies for an exemption and foreign air carrier permit authorizing it to engage in charter foreign air transportation of persons, property and mail between a point or points in Finland, on the one hand, and a point or points in the United States, on the other hand, via intermediate points. Air Finland requests that the exemption authority requested herein remain in effect until the Department issues it an effective permit. Oy Air Finland Ltd is a Finnish airline founded in 2002. It started operations with a first flight from Helsinki, Finland to Malaga, Spain with a fleet of one Boeing 757-200 aircraft. The current fleet consists of three Boeing 757-200 aircraft and at present the company employs approximately 200 people. Since then, the company has grown steadily and successfully and has established itself on the Finnish and Scandinavian aviation markets concentrating mainly on fights to holiday and leisure destinations worldwide. The majority of the operations are non-scheduled flights chartered by tour operators but also include scheduled flights from Finland to Malaga and Alicante, Spain, which are operated throughout the year. Routes have included destinations in Thailand, India, Egypt, Brazil, Venezuela, Canada, Senegal and various points in Europe. Order 2007-6-16 Issued and Served June 29, 2007 Order Granting Exemption and to Show Cause We grant the request of Oy Air Finland Ltd. for an exemption under 49 U.S.C. 40109 to permit it to engage in charter foreign air transportation of persons, property and mail between a point or points in Finland, on the one hand, and a point or points in the United States, on the other hand, via intermediate points, and to conduct other charters under Part 212 of the Department’s Regulations. Our action granting the exemption authority described herein is effective immediately, for a period of two years from the issue date of this order, or until the attached permit becomes effective, whichever is earlier. With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Order 2007-9-27 Issued July 23, 2007 | Served September 26, 2007 By Order 2007-6-16, issued June 29, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order. No objections were received within the time period provided. We make final our findings and conclusions as stated in the Order and award to Oy Air Finland Ltd. the foreign air carrier permit. OST-2007-28129 - Exemption and Foreign Air Carrier Permit - Finland-US Charters January 14, 2008 Application for an Exemption and Amended Foreign Air Carrier Permit Air Finland Ltd., an air carrier of the Republic of Finland, respectfully requests that the Department amend Air Finland’s foreign air carrier permit to engage in charter air transportation of persons, property, and mail, between a point or points in the European Union and European Common Aviation Area, and a point or points in the United States, via intermediate points, to the full extent allowed under the Air Transport Agreement between the United States and the European Community and the Member States of the European Community. Air Finland requests that the Department process this application on an expedited basis and grant Air Finland’s amended foreign air carrier permit so Air Finland can begin selling the proposed services as soon as possible. In this regard, Air Finland respectfully requests the Department issue a single order: (1) granting the requested exemption authority for a two-year period or until after the effective date of the requested amended permit authority; and (2) approving amended foreign air carrier permit authority under the streamlined procedures set forth in the August 23, 2005 Notice, unless the Department deems that proceeding directly to a final order issuing an amended foreign carrier permit to Air Finland is appropriate. Order 2008-2-33 Issued and Served February 27, 2008 Order Granting Exemption and to Show Cause We grant the request of Oy Air Finland Ltd. for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payments, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, for the services set forth below: a) foreign charter air transportation of persons, property and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) foreign charter air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c) foreign charter cargo air transportation between any point or points in the United States and any point or points; d) other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department’s regulations; and e) charter transportation authorized by any additional route rights made available to European Community carriers in the future. To the extent not acted upon above, we dismiss the applicant’s request for exemption authority in Docket OST-2008-0022. With respect to the applicant’s request for an amended foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for an amended foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
