Motion for Confidential Treatment

Star Air is seeking an exemption and Foreign Air Carrier Permit that would enable it to provide charter foreign air transportation of property and mail:

  1. Between any point or points in the territory of Denmark and any point of points in the U.S.; and
  2. Between any point or points in the territory of the U.S. and any point or points in a third country or countries; provided that such service constitutes part of a continuous operation, with or without change of aircraft, that includes service to Denmark for the purpose of carrying local traffic between Denmark and the U.S.

Star Air operates 11 Boeing 767-200SF series aircraft configured for cargo transport. Exhibit F contains a list of these aircraft.

All of the shares of Star Air are owned by the Danish company A/S Maersk Aviation Holding, which is wholly owned by the Danish company A.P. Moller - Masrsk A/S. A.P. Moller - Maersk A/S is publicly traded on the Copenhagen Stock Exchange and has approximately 53,000 registered shareholders.

Order Granting Exemption and to Show Cause

We grant Star Air A/S an exemption under 49 U.S.C. 40109 to permit it to engage in charter foreign air transportation of property and mail between any point or points in Denmark, on the one hand, and a point or points in the United States, on the other hand; and between any point or points in the United States and any point or points in a third country or countries provided that such service constitutes part of a continuous operation, with or without change of aircraft, that includes service to Denmark for the purpose of carrying local traffic between Denmark and the United States. Star Air may also engage in other charter trips in foreign air transportation, subject to the terms, conditions, and limitations of the Department’s regulations governing charters.

Our action granting the exemption authority described herein is effective immediately, for a period of two years from the issue date of this order, or until the attached permit becomes effective, whichever is earlier.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final.

By Order 2007-7-10, issued July 11, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto.  We gave interested persons 21 days to file objections to the Order.  We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.

Application for an Amended Foreign Air Carrier Permit and Exemption Authority

Star Air A/S requests that the Department amend Star Air's existing Foreign Air Carrier Permit, which was issued by Order 2007-10-15, to incorporate the new rights made available to European air carriers pursuant to the Air Transport Agreement between the United States and the European Community and the Member States of the European Union). Star Air also requests related exemption authority pursuant to 49 U.S.C. § 40109 to the extent necessary to enable it to provide the services covered by this Application while the Department evaluates Star Air's Application to amend its Foreign Air Carrier Permit.

Star Air requests that the Department grant it the right to provide the following: a) Foreign scheduled and charter air transportation of property and mail from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) Foreign scheduled and charter air transportation of property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c) Foreign scheduled and charter cargo air transportation between any point or points in the United States and any other point or points; d) Other charters pursuant to the prior approval requirements set forth in Part 212 of the Department's Economic Regulations; and e) Transportation authorized by any additional route rights made available to European Community carriers in the future.

We grant the request of Star Air A/S for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payments, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, for the services set forth below: (a) foreign scheduled and charter air transportation of persons, property and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; (b) foreign scheduled and charter air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; (c) foreign scheduled and charter cargo air transportation between any point or points in the United States and any point or points; (d) other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department's regulations; and (e) transportation authorized by any additional route rights made available to European Community carriers in the future.

To the extent not acted upon above, we dismiss the applicant's request for exemption
authority in Docket OST-2007-28073.

With respect to the applicant's request for an amended foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant's request for an amended foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
