OST-2007-27416 - Exemption and Foreign Air Carrier Permit - Ecuador-US Scheduled Passenger February 22, 2007 Application for an Exemption and Foreign Air Carrier Permit - Bookmarked AeroGal initially intends to operate flights between Ecuador and the United States with either its Boeing 737 aircraft, or with 757/767 aircraft that it is currently seeking to acquire. AeroGal proposes to initiate seven (7) non‑stop flights per week between Quito, Ecuador and Miami and seven (7) non‑stop flights per week between Quito, Ecuador and New York (JFK) beginning in the late Spring of 2007. AeroGal has been operating in Ecuador and to other destinations since 1986 and now intends to expand its operations to bring additional service opportunities to the U.S. market. Order 2007-7-8 Issued and Served July 10, 2007 Order Granting Exemption and to Show Cause We grant the request of Aerolineas Galapagos AeroGal, S.A. for an exemption under 49 U.S.C. 40109 to permit it to engage in: 1) scheduled foreign air transportation of persons, property, and mail between a point or points in Ecuador and the co-terminal points Miami, Florida, and New York, New York; and 2) charter foreign air transportation of persons, property, and mail between Ecuador and the United States, and other charters in accordance with 14 CFR Part 212. Our action granting the exemption authority described herein is effective immediately, for a period of one year from the issue date of this order, or until the attached permit becomes effective, whichever is earlier. With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall file no later than twenty-one calendar days after the date of service of this order. Order 2007-10-13 Issued August 7, 2007 | Served October 11, 2007 By Order 2007-7-8, issued July 10, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 U.S.C. §41307) which will make final the findings and conclusions of the Order.
