Joint Application for Statements of Authorization and an Exemption - Bookmarked

US Airways, Inc., America West Airlines, Inc., and Royal Jordanian Airlines have amended the previously approved code-share agreement between America West and Royal Jordanian (See Order 2005-1-23). Accordingly, US Airways and Royal Jordanian jointly apply for issuance of statements of authorization under 14 C.F.R. Part 212 in order to implement code-sharing arrangements provided for in Amended Code Share Agreement, attached hereto as Exhibit 1.2 In addition, US Airways seeks the underlying exemption authority necessary to support this codesharing. US Airways and Royal Jordanian plan to code-share between points in the United States and Jordan, both non-stop and via intermediate points, and to third-country points beyond the United States and beyond Jordan. The carriers request expedited treatment for this Application.

US Airways and Royal Jordanian do not seek antitrust immunity with this Joint Application. Moreover. America West and Royal Jordanian hereby notify the Department that upon issuance of the statements of authorization and exemption requested herein, the antitrust immunity granted to the carriers in Order 2005-1-23 will be discontinued.

  • US Airways requests a statement of authorization for blanket code-share authority to display Royal Jordanian's "RJ" designator code on flights operated by US Airways (1) between any points within the United States in conjunction with services held out by Royal Jordanian between Jordan and the United States (either non-stop or via third country intermediate points); and (2) between any points in the United States and any points in third countries. The specific routes that are initially covered by the above code-sharing arrangement are described in Appendix A.
  • Royal Jordanian requests a statement of authorization for blanket codeshare authority to display US Airways' 'US" designator code on flights operated by Royal Jordanian (1) between any point in Jordan and any point in the United States (either non-stop or via third country intermediate points); and (2) between any points in Jordan and points in third countries. The specific routes that are initially covered by the above code-sharing arrangement are described in Appendix B.
  • US Airways also requests the underlying exemption authority necessary in order to engage in these code-sharing arrangements with Royal Jordanian.

US Airways and Royal Jordanian intend to begin operating the proposed code-share arrangements as early as March 3, 2007. To that end, US Airways and Royal Jordanian will poll the U.S. carrier representatives served with this application and will notify the Department promptly of the results of this poll. US Airways and Royal Jordanian request that the Department act upon this application as expeditiously as possible.

Motion for Confidential Treatment

US Airways respectfully moves to withhold from public disclosure the confidential versions of the code-share contracts and amendments submitted to the Department today. In accordance with Rule 12, US Airways is submitting copies of the confidential documents to the Department separately in a sealed envelope bearing the caption for the cases and marked "Confidential Treatment Requested Under § 302.12."

The information for which US Airways requests confidential treatment is confidential and competitively sensitive information. The public release of that information would cause US Airways substantial competitive and financial injury. Accordingly, the information should be withheld from public disclosure.

US Airways is submitting in this docket copies of the code-share contracts and amendments with the confidential portions redacted. These redacted versions are being served on all persons on the attached service list.
