Jet Aviation Business Jets AG OST-2007-27264 - Exemption and Foreign Air Carrier Permit - Switzerland-US Charters February 9, 2007 Application for an Exemption and a Foreign Air Carrier Permit - Bookmarked Jet Aviation Business Jets AG, a Swiss foreign air carrier, hereby applies under 49 U.S.C. § 41302 and 40109, Subparts B and C of the Department's Rules of Practice in Proceedings, Part 211 of the Department's Economic Regulations, and the Department's August 23, 2005 Notice in Docket OST-2005-22228 for an exemption and a foreign air carrier permit authorizing JBJA to provide the following service:
JBJA requests that the Department promptly issue a single Order under the show‑cause procedures described in the Streamlined Licensing Procedures Notice (a) granting the requested exemption authority for a period of two years, or until the effective date of JBJA's final foreign air carrier permit, whichever occurs first, and (b) tentatively awarding the corresponding foreign air carrier permit. As soon as possible thereafter, JBJA requests that the Department issue a Final Order issuing the Company its foreign air carrier permit for a period of indefinite duration. JBJA is seeking issuance of a DOT exemption and foreign air carrier permit so that it may operate Switzerland-U.S. charter flights and other charter flights under 14 C.F.R. Part 212, without limitation as to the number of annual flights. JBJA provides executive jet charter services to worldwide destinations. JBJA's commercial fleet currently consists of one DC-8-72 aircraft with 32 seats in a "VIP" seating configuration, plus one Falcon 900, one Cessna Excel, and three Cessna Bravos. Order 2008-3-17 Issued and Served March 19, 2008 Order Granting Exemption and to Show Cause We grant the request of Jet Aviation Business Jets AG for an exemption under 49 U.S.C. §40109 to permit it to engage in charter foreign air transportation of persons, property, and mail (1) between any point or points in Switzerland and any point or points in the United States; (2) between any point or points in the United States and any point or points in a third country or countries, provided that such service constitutes part of a continuous operation, with or without a change of aircraft, that includes air service to Switzerland for the purpose of carrying local traffic between Switzerland and the United States; and (3) between third countries and the United States in accordance with 14 CFR Part 212. We grant the request of Jet Aviation Business Jets AG for confidential treatment of its financial submissions. To the extent not acted upon above, we dismiss the applicant’s request for exemption authority in this docket (OST-2007-27264). With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
