Jade Cargo commenced all-cargo service in August 2006 with scheduled flights between Shenzhen, China, on the one hand, and Amsterdam, the Netherlands; and Seoul, South Korea; on the other hand. Recently, Jade Cargo expanded its scheduled all-cargo services to include flights between Shenzhen, on the one hand, and Brescia, Italy; Barcelona, Spain; and Osaka, Japan; on the other hand. In operating its all-cargo services, Jade Cargo currently utilizes its fleet of two Boeing 747-400ERF aircraft, and will take delivery of four additional aircraft on a phased basis between now and early 2008.

Jade Cargo now proposes to expand its services to include charter flights between points in the People's Republic of China and points in the United States. Initially, Jade Cargo plans to operate up to three roundtrip all-cargo charter flights per week between Shenzhen, China and Houston, Texas with technical stops in Anchorage, Alaska over a Shenzhen-Anchorage-Houston-Anchorage-Shenzhen routing. These charter flights, which will originate in Shenzhen, will be operated using B747-400 ERF aircraft. Jade Cargo plans to commence its U.S-China all-cargo charter services on or after April 1, 2007. The flights will be operated based on the ad hoc demands of charter customers, and may be expanded to include service to other points in both the U.S. and China based on future customer needs.

Jade Cargo is concurrently filing both this foreign air carrier permit application and a corresponding exemption application and requests that the Department review these applications under the streamlined regulatory procedures announced on August 23, 2005 (Docket OST-2005‑22228).

Answer of the City of Houston and the Greater Houston Partnership

Jade Cargo specifically has proposed to operate all-cargo services between Shenzhen and Houston, with a technical stop in Anchorage. The proposed operations would be of great benefit to the Greater Houston area, and are within the scope of the bilateral aviation agreement between the United States and China. Accordingly, the Houston Parties urge that Jade Cargo’s applications promptly be granted by the Department.

Additionally, the Houston Parties also support Jade Cargo’s request that DOT waive the ownership and control requirements applicable to Chinese air carriers, to the extent that a waiver may be deemed necessary, in conformity with DOT’s practice in other cases.
