Joint Application for an Exemption and a Statement of Authorization - Bookmarked

Delta Air Lines, Inc. and Aerovias de Mexico, S.A. de C.V. hereby apply for authority to expand their codeshare arrangement to include the display of Aeromexico's code on certain additional transborder U.S.-Mexico flights operated by Delta. Specifically, the Joint Applicants request issuance of the following authorities:

  1. a statement of authorization to Delta pursuant to 14 C.F.R. Part 212 to permit Delta to display Aeromexico's "AM" designator code on flights operated by Delta on the U.S.‑Mexico routes identified in Exhibit A; and
  2. an exemption to Aeromexico pursuant to 49 U.S.C. § 40109 authorizing Aeromexico to engage in scheduled foreign air transportation of persons, property and mail on the U.S.‑Mexico routes identified in Exhibit A.

Aeromexico plans to begin marketing and sales activities and to introduce service on the proposed U.S. -Mexico codeshare routes as soon as possible after this application has been approved. Accordingly, the Joint Applicants request that the exemption and statement of authorization be promptly granted. Aeromexico requests that its exemption authority be effective for a period of at least one year.

We have polled the US carrier representatives served with the above-referenced application, and no carrier has objected to Delta and Aeromexico's requests for a statement of authorization and exemption authority. The Joint Applicants urge that the application be granted as soon as possible.

Notice of Action Taken

Exemption: Scheduled foreign air transportation of persons, property, and mail on the following U.S.-Mexico routes: Atlanta-Acapulco, Atlanta- Ixtapa/Zihuatanejo, Atlanta-Puerto Vallarta, Cincinnati-Cancun, Cincinnati-San Jose del Cabo, Los Angeles-Acapulco, Los Angeles-Cancun, Los Angeles-Ixtapa/Zihuatanejo, Los Angeles-Puerto Vallarta, New York/Newark-Acapulco, New York/Newark-Cozumel, New York/Newark-San Jose del Cabo, Washington, D.C.-Cancun. The applicants state that they will use the authority pursuant to a code-share arrangement, whereby Aeromexico's "AM" designator code will be placed on flights operated by Delta in these markets.

Aeromexico already holds exemption authority to serve the New York/Newark-Cozumel and New York/Newark-San Jose del Cabo markets; however, that authority is limited to code-share services between Aeromexico and Continental Air Lines, Inc.

Statement of Authorization: Display Aeromexico's "AM" designator code on flights operated by Delta on the U.S.‑Mexico routes listed above.

Application of Aeromexico for Renewal of Exemption Authority

By this application, Aeromexico seeks renewal of its exemption authority granted by Notice of Action Taken, dated February 1, 2007, to provide service over the following routes by displaying its AM code on flights operated by Delta:

Atlanta-Acapulco
Atlanta-Ixtapa/Zihuatenejo
Atlanta-Puerto Vallarta
Cincinnati-Cancun
Los Angeles-Acapulco
Los Angeles-Cancun
Los Angeles-Ixtapa/Zihuatenejo
New York-Acapulco
New York-San Jose del Cabo

Aeromexico does not seek renewal of the Cincinnati-San Jose del Cabo, New York-Cozumel and Washington-Cancun routes which also were granted by the Notice.

Aeromexico currently is serving some of the routes by displaying its code on Delta flights and it wants to continue the service for another year. It also wants to renew the other routes so that service may be provided when warranted by traffic volumes

Renewal of exemption from 49 USC §41301 to permit the applicant to conduct scheduled foreign air transportation of persons, property, and mail on the following U.S.-Mexico routes: Atlanta-Acapulco, Atlanta-Ixtapa/Zihuatenejo, Atlanta-Puerta Vallarta, Cincinnati-Cancun, Los Angeles-Acapulco, Los Angeles-Cancun, Los Angeles-Ixtapa/Zihuatenejo, New York/Newark-Acapulco, and New York/Newark-San Jose del Cabo. The applicant states that it operates these services pursuant to its codeshare arrangement with Delta Air Lines, Inc.

Our February 1, 2007 action also awarded Aeromexico authority to serve the Cincinnati-San Jose del Cabo, New York/Newark-Cozumel, and Washington, D.C.-Cancun markets pursuant to its code-share arrangement with Delta. Aeromexico is not seeking to renew its authority to serve those routes in this application.
