OST-2007-0123 - Foreign Air Carrier Permit and Exemption - Europe-US December 21, 2007 Application for a Foreign Air Carrier Permit and Amended Exemption Authority The United States and the European Community successfully concluded negotiations for a new air transport agreement on March 2, 2007. The US‑EC Agreement was approved by the European Council on March 22, 2007 and was signed on April 30, 2007 to be provisionally applied beginning March 30, 2008. TAG España is requesting authority to the full extent provided by the existing US‑EC Agreement and automatic application of additional rights made available to European Community carriers in the future. TAG Espana currently operates to the United States pursuant to its exemption authority that was initially issued by Notice of Action Taken on March 29, 2006 in Docket OST-2005-23073 and renewed on April 11, 2007. Order 2008-4-35 Issued and Served April 24, 2008 Order Granting Exemption and to Show Cause We grant the request of TAG Aviation España S.L. for an exemption under 49 U.S.C. §40109 for the services: (a) Foreign charter air transportation of persons and property from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; (b) Foreign charter air transportation of persons and property between any point or points in the United States and any point or points in any member of the European Common Aviation Area; (c) Other charters pursuant to the prior approval requirements set forth in the Department’s regulations governing charters; and (d) Transportation authorized by an additional route rights made available to European Community carriers in the future. To the extent not acted upon above, we dismiss all requests for exemption authority in the referenced dockets (OST-2007-0123 and OST-2005-23073). With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department. Order 2008-7-18 Issued May 16, 2008 | Served July 14, 2008 By Order 2008-4-35, issued April 24, 2008, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 U.S.C. §41307) which would make final the findings and conclusions of the Order.
