Application for a Certificate of Public Convenience and Necessity

In order to strengthen its international service, Eos hereby asks the Department to award it certificate authority to engage in interstate scheduled air transportation of persons, property and mail

Eos currently provides 44 nonstop flights per week between New York (JFK) and London (Stansted) with B-757-200. The Eos aircraft are configured in low-density seating with only 48 seats (one aircraft has 47 seats), in order to offer passengers a highquality, unique, first-class level of service at prices that are substantially below first class service offered by competing air carriers using conventional two or three class seating configured equipment. On October 19, 2007, the Department granted Eos's request to add six aircraft to its fleet, bringing its total fleet to 10 aircraft.

Supplement No. 1

Eos Airlines, Inc. hereby files this Supplement No. One to its application for a certificate of public convenience and necessity to engage in interstate scheduled air transportation of persons, property, and mail. It is requested that the financial information contained in this Supplement No. One be withheld from public disclosure because of the information and data contained in those documents.

The filing contains commercially sensitive financial information which, if released publicly, could cause substantial competitive harm to Eos. These materials would not otherwise be disclosed to the public by Eos.

Re: DOT Denying Confidential Treatment Request

With regard to Eos's request for confidential treatment of its current balance sheet and income statement, it is not the Department's practice to withhold from public disclosure information relating to the applicant's financial statements, first-year expense forecasts and forecasted balance sheets, nor is it our practice to withhold from public disclosure documents that contain information that is already publicly available from other sources. Moreover, section 204.3 of the Department's rules requires an air carrier, as part of the fitness determination process, to provide information on its current financial condition in the public docket. Therefore, we are denying Eos's request for confidential treatment.

I have reviewed your February 12th submission, and there are a few things that I still need:

  • Please provide a breakdown of the carrier's proposed markets, including block hours and the number of flights per aircraft (seasonal/year-round).
  • Please submit an explanation of the carrier's current ownership structure in the public docket.
  • Please submit a list of the carrier's technical personnel (i.e. Director of Operations, Director of
    Maintenance, Director of Safety, Chief Pilot, etc.)
  • Please provide a list of any pre-operating costs the carrier is expecting to incur. If this information has been submitted, please specify where in the filing it is detailed.
  • Please provide the carrier's most recent financial statements.
