OST-2007-0107 - Exemption and Statement of Authorization - Blanket Codesharing
OST-2004-19214 - Approval of and Antitrust Immunity for Alliance Agreements

December 12, 2007

Joint Application for Exemptions and Statements of Authorization and Motion to Consolidate - Bookmarked

Air France regional carriers Brit Air and CityJet Limited hereby request blanket statements of authorization under 14 C.F.R. Part 212, to the extent necessary so that Brit Air and CityJet can engage in codeshare operations with Northwest over the intra-European city-pair segments on which Brit Air and CityJet operate flights for societe Air France. It is requested that the blanket statements of authorization remain in effect for a period of unlimited duration.

The Joint Applicants further request that future notices to serve a point given by Air France also be deemed as notice given for Brit Air and/or CityJet and vice versa. This will alleviate unnecessary administrative burdens on the Joint Applicants and the Department by allowing routine schedule changes as necessary to promote the efficient allocation of flying between Air France's mainline and regional carrier equipment. The Joint Applicants request prompt approval so that the marketing and sale of these codeshare flights can begin as soon as possible. (See Brit Air/Delta Notice of Action Taken, dated August 2, 2002, Dockets OST-2001-10354 and OST-2000-6939).

Notice of Action Taken

The Joint Applicants also request consolidation of these applications in Docket OST-2007-0107 into Docket OST-2004-19214, the Docket established by the Department for the administration of the grant of the blanket statements of authorization to engage in reciprocal code sharing issued to Northwest and Air France.

Brit Air and CityJet will not sell seats in their names for travel to or from the United States and will not operate their aircraft to any U.S. points.

Application to Modify Statements of Authorization

In the applications for the statements of authorization granted, Northwest and the Air France Regionals requested, for administrative purposes, that these codeshare authorizations be consolidated into Docket OST-2004-19214, the Docket established by the Department for the administration of the grant of blanket statements of authorization to engage in reciprocal codesharing issued to Northwest and Air France, and that future codeshare notices for one Air France Regional be deemed notice filed by Air France and other Air France Regionals as well. Although both NOATs recite the request for consolidation as part of the relief requested and indicate "approval," the applicants' specific requests for relief such that "any future code-share notice given for Air France [or an Air France regional carrier] be deemed as notice given for either carrier" were either overlooked or never expressly granted. See NOAT dated March 4, 2008, Docket OST-2007-28643. Therefore, Northwest and the Air France Regionals request that the following footnote, substituting the Air France Regional carrier names where appropriate, be added to the codeshare conditions included in each of the NOATs cited above:

"Northwest and [Regional][CityJet][Brit Air] request that the Northwest/[Regional][CityJet][Brit Air] code-share authority be administered jointly with the existing Northwest/Air France blanket statement of authorization in Docket OST-2004-19214 and that a code-share notice given by Air France or [Regional][CityJet][Brit Air] be deemed notice given by all of the Air France carriers. We grant the requests, subject to compliance by the filing carrier with the terms of this condition."

As a result of the Department's footnote, it is clear in the case of Northwest and the Northwest Airlink Carriers that a codeshare notice for one Northwest carrier will be deemed as notice for all the other Northwest carriers. Thus, similar treatment should be granted in connection with the Northwest/Regional and Northwest/Brit Air/CityJet statements of authorization, and the NOATs dated February 25 and March 4, 2008 should be modified with the addition of the footnote text identified in italics above.

Notice of Action Taken - Corrected Copy

Exemptions under 49 USC §40109 and statements of authorization pursuant to 14 CFR 212 of the Department’s regulations to permit Brit Air and CityJet to display the airline designator code of Northwest over the intra-European city-pair segments on which Brit Air and CityJet operate flights for Société Air France.

The code-share partners provided a listing of specific code-share markets that they intend initially to serve under this arrangement.

Brit Air and CityJet will not sell seats in their names for travel to or from the United States and will not operate their aircraft to any U.S. points.

On March 11, 2008, the joint applicants requested a modification to its statement of authorization to allow the code-share condition that permits notice given by Air France, CityJet, or Brit Air be deemed notice given by all the Air France carriers. We are granting the request.
