Application for a Foreign Air Carrier Permit

Astraeus, a wholly-owned subsidiary of Northern Travel Holding, which is a company incorporated in Iceland, and owned and controlled by Icelandic nationals, hereby applies for an exemption and Foreign Air Carrier Permit to provide scheduled and charter air transportation of persons, property, and mail to the full extent allowed under the Air Transport Agreement between the United States and the European Community and the Member States of the European Union.

The US/EC Air Transport Agreement is expected to become effective no later than March 30, 2008. Astraeus, therefore, seeks an effective date of March 30, 2008 for authority under the US/EC Air Transport Agreement.

The authority sought by Astraeus is identical to the authority recently sought by British Airways, which the Department granted on June 29, 2007 (Order 2007-6-19).

With this supplement, Astraeus hereby submits additional information in support of its Application.

Astraeus is eager to enter the EU-U.S. market and to utilize rights made available to it under the new EU-U.S. open skies arrangement. Accordingly, Astraeus requests that the Department grant the requested exemption and permit authority so that Astraeus may begin to market its proposed services as soon as possible and conduct the service described in its Application upon the effective date of the new Agreement.

Order Granting Exemption and to Show Cause

By this order we (1) grant the application of the referenced foreign air carrier for an exemption under 49 U.S.C. §40109, subject to conditions; and (2) tentatively find that it is in the public interest to grant the applicant the foreign air carrier permit.

We grant the request of Astraeus Limited for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payments, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, for the services: a) foreign scheduled and charter air transportation of persons, property, and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) foreign scheduled and charter air transportation of persons, property, and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c) foreign scheduled and charter cargo air transportation between any point or points in the United States and any point or points; d) foreign scheduled and charter cargo air transportation between any point or points in the United States and any point or points; e) transportation authorized by any additional route rights made available to European Community carriers in the future.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

Final Order

By Order 2008-2-18, issued February 13, 2008, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 U.S.C. §41307) which would make final the findings and conclusions of the Order.

No objections were received within the time period provided.
