Motion for Confidential Treatment

Private Air Charters LLC hereby applies for issuance of commuter air carrier authority to enable PAC to engage in interstate and foreign scheduled air transportation operations utilizing small aircraft under Part 298 of the Department’s Economic Regulations.

PAC has successfully operated as a Part 298 on-demand air charter carrier since March 21, 2007. Due to the operational limitations of operating as an air taxi, the Applicant has decided to obtain commuter authority to give it maximum operational flexibility, although the nature of PAC’s operations will not actually change in terms of geographical scope of operations, level of operations, hours-per-month flown, number of employees, etc.

PAC currently operates three Dornier 328JET aircraft configured to carry thirty passengers. PAC currently also has two Dornier 328JET aircraft under contract with an expected in-service timeframe of January 2008.

Re: DOT Granting Confidential Treatment

We have reviewed the confidential material and have decided to grant PAC's request to withhold from public disclosure the aforementioned credit agreement. We agree that public disclosure of this financing agreement is the type of proprietary information for which we have given confidential treatment in the past. However, we note that a brief description of the funding agreement, including the amount of funding to be provided to the applicant, must be submitted in the public docket.

Issued and Served July 15, 2008

Order Dismissing Application

On November 15, 2007, PAC filed an application requesting that the Department issue it a commuter air carrier authorization in order to engage in scheduled passenger service operations as a commuter air carrier.

On July 11, 2008 PAC filed a request to withdraw its application.

In light of the above, we have decided to dismiss, without prejudice, PAC's application in Docket OST-2007-0073.
