Order Revoking Certificate Authority

We revoke the certificate of public convenience and necessity issued to Larry’s Flying Service, Inc., as amended and reissued by Order 1998-7-6 authorizing it to engage in interstate charter air transportation of persons, property, and mail.

By letters dated August 23, 2005, November 3, 2005, and May 8, 2006, the Department granted Larry’s extensions to submit the information necessary to re-determine the air carrier’s fitness while Larry’s was, presumably, making progress with the Federal Aviation Administration in obtaining a Part 135 Air Carrier Operating Certificate from the FAA. However, on June 27, 2006, Larry’s notified the FAA that it would be unable to complete its application and requested termination of the certification process. As a consequence, on July 10, 2006, the FAA officially terminated the certification process.

Under these circumstances, and in accordance with section 204.7 of our rules, we find it appropriate to revoke Larry’s certificate authority. This action is without prejudice to the company’s filing for new certificate authority in the future.
