VistaJet Luftfahrtunternehmen GmbH OST-2006-26328 - VistaJet - Exemption and Foreign Air Carrier Permit - Austria-US November 8, 2006 Application for an Exemption and Foreign Air Carrier Permit - Bookmarked VistaJet, a foreign air carrier based in Salzburg, Austria, hereby applies for an exemption and a foreign air carrier permit authorizing VistaJet to provide the following service using small aircraft:
VistaJet is a Salzburg-based executive jet air transportation provider that was founded earlier this year as a restructured successor company to another Austrian carrier, Air Executive LU.at GmbH. Aircraft, operational resources, personnel and other assets have recently transitioned from Air Executive to VistaJet for operations under its newly-issued Air Operator Certificate. Air Executive holds a DOT exemption issued by Notice of Action Taken dated November 29, 2004 (Docket OST-2004-19503), and has an application pending for a Foreign Air Carrier Permit (Docket OST-2004-19500). Air Executive will allow its exemption to expire and move for dismissal of its pending permit application in due course. VistaJet and its predecessor company have focused on providing private and exclusive charter service between points in Europe and various destinations worldwide using medium to long-range business jets. There are currently six aircraft in VistaJet's fleet: four Challenger 604 business jets and two Learjet 60 aircraft. In light of VistaJet's successful launch, its strong customer base, and its assessment of additional opportunities within the executive air taxi market, the Company has ambitious growth plans. In late 2007, VistaJet plans to take delivery of two ultra long-range Global Express XRS business jets and two next-generation Challenger 605 business jets, with additional deliveries of each of these and other aircraft types to follow in ensuing years. OST-2004-19503 - Foreign Air Carrier Permit - Austria-US Executive Charters Re: Dismissal of Application for a Foreign Air Carrier Permit Hereby withdraws, and moves for dismissal of, its Application for a Foreign Air Carrier Permit pending in Docket OST-2004-19500. Air Executive has ceased air transportation operations. The company's relevant assets and operations have transitioned to a new company, VistaJet Luftfahrtunternehmen GmbH, which applied for DOT permit/exemption authority on November 8, 2006 in Docket OST-2006-26328. Order 2006-12-15 Issued and Served December 18, 2006 Order Granting Exemption and to Show Cause We grant the request of VistaJet Luftfahrtunternehmen GmbH for an exemption under 49 U.S.C. §40109 to permit it to engage in charter foreign air transportation of persons, property and mail, using small aircraft, (1) between any point or points in Austria and any point or points in the United States; (2) between any point or points in the United States and any point or points in a third country or countries, provided that such service constitutes part of a continuous operation, with or without a change of aircraft, that includes air service to Austria for the purpose of carrying local traffic between Austria and the United States; and (3) other charters between third countries and the United States in accordance with 14 CFR Part 212. In the conduct of these operations, VistaJet Luftfahrtunternehmen GmbH may only use aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds. Our action granting the exemption authority described herein is effective immediately, for a period of two years from the issue date of this order, or until the attached permit becomes effective, whichever is earlier. With respect to the applicant's request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application should not be made final. Order 2007-3-7 Issued January 9, 2007 | Served March 12, 2007 By Order 2006-12-15, issued December 18, 2006, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order. No objections were received within the time period provided. We make final our findings and conclusions as stated in the Order and award to VistaJet Luftfahrtunternehmen GmbH the foreign air carrier permit. By: Paul Gretch
July 26, 2007 Application for an Exemption and Amended Foreign Air Carrier Permit - Bookmarked VistaJet hereby applies for an exemption and an amended foreign air carrier permit authorizing VistaJet to conduct the following services using small aircraft, in addition to the charter services authorized under its existing foreign air carrier permit, as of March 30, 2008:
VistaJet specifically requests prompt issuance of an order (a) granting exemption authority (i) to accept payment and enter into charter contracts in anticipation of the March 30,2008 effective date of the EU-U.S. open-skies agreement, and (ii) to commence charter flight operations under the agreement effective on that date; and (b) tentatively granting the amended foreign air carrier permit covering the EU-U.S. open-skies charter services described in this application. As soon as possible thereafter, VistaJet requests issuance of a final order making its EU-US open-skies permit effective on March 30, 2008. Order 2007-8-18 Issued and Served August 17, 2007 Order Granting Exemption and to Show Cause We grant the request of VistaJet Luftfahrtunternehmen GmbH for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payments, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, using small aircraft, for the services: a. charter foreign air transportation of persons, property and mail from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b. charter foreign air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c. other charters pursuant to the prior approval requirements set forth in 14 CFR Part 212 of the Department’s regulations; and d. charter transportation authorized by any additional route rights made available to European Community carriers in the future. With respect to the applicant’s request for an amended foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final, no later than twenty-one calendar days after the date of service of this order.
