Motion to Withhold Information from Public Disclosure

GJL is a privately held company founded in 1997 by Mr. Antoine David, a former pilot and the company's current President and Director. GJL is incorporated and headquartered in Luxembourg and has been operating international business aviation and charter services since January 1999. The company has grown from just a few employees in 1999 to nearly 200 employees in 2006, including its technical department, crew and administrative staff. Since 1999, GJL has expanded its services and added sixteen aircraft, including three Global Express aircraft and a Boeing Business Jet, which are available for worldwide charter services. Over the next two years, GJL plans to add an additional seven business aircraft to its fleet and expand its services to various destinations in the United States. The additional aircraft will complement the existing fleet and allow GJL to maintain and expand its current level of charter services around the world while also providing its clients with additional travel opportunities to the U.S.

GJL estimates a traffic forecast of fifty flights or less to the United States in the first year of operations. Based on hourly hire rates, this will result in approximately USD16 million gross revenue before tax and all other expenses are paid.

By Order 2007-2-24, issued February 26, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto.  We gave interested persons 21 days to file objections to the Order.  We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order

No objections were received within the time period provided.

We make final our findings and conclusions as stated in the Order and award to Global Jet Luxembourg S.A. the foreign air carrier permit and conditions attached to the Order.

Application for an Amended Foreign Air Carrier Permit and Exemption Authority

Global Jet Luxembourg SA requests an amended foreign air carrier permit to the full extent authorized by the Air Transport Agreement Between the United States and the European Community and the Member States of the European Community to enable it to engage in: a) foreign charter air transportation of persons and property from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) foreign charter air transportation of persons and property between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c) other charters pursuant to the prior approval requirements set forth in Part 212 of the Department's Economic Regulations; and d) transportation authorized by any additional route rights made available to European Community carriers in the future.

OJL requests that the authority described above be issued expeditiously. Given that the US-EC Agreement will take effect March 30, 2008, GJL requests that the authority be granted to become effective as of that date or on any earlier date on which the US-EC Agreement is being applied.

Order Granting Exemption and to Show Cause

We grant the request of Global Jet Luxembourg S.A. for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payments, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, for the services set forth below: (a) foreign charter air transportation of persons and property from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; (b) foreign charter air transportation of persons and property between any point or points in the United States and any point or points in any member of the European Common Aviation Area; (c) other charters pursuant to the prior approval requirements set forth in the Department’s regulations governing charters; and (d) transportation authorized by any additional rights made available to European Community carriers in the future.

To the extent not acted upon above, we dismiss all requests for exemption authority in Docket OST-2008-0013.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
