Global Jet Austria GmbH OST-2006-26199 - Foreign Air Carrier Permit - Austria-US Executive Charters October 25, 2006 Application for a Foreign Air Carrier Permit - Bookmarked GJA is a privately held company founded in 2005 by Global Jet Luxembourg S.A. and Mr. Antoine David, GJA's President and Finance Director. GJA is based in Austria and operates international business aviation and charter services on an on demand, ad hoc basis to European clientele. GJA currently operates to worldwide destinations and plans to expand into the transatlantic market. GJA estimates a traffic forecast of twenty flights or less to the United States in the first year of operations. Based on hourly hire rates, this will result in approximately USD $2 million gross revenue before tax and all other expenses are paid. GJA is 80 percent owned by Albatross Capital S.A., a Luxembourg corporation, which is in turn owned by Antoine David, President and Finance Director of GJA and a French citizen. GJA is 20 percent owned by Global Jet Luxembourg S.A. Global Jet Luxembourg S.A. is 90 percent owned by Albatross Capital S.A., which, as stated above, is owned by Antoine David. Global Jet Luxembourg S.A. is 9.92 percent owned by Moorhouse Development Limited, a BVI company, which in turn is owned by Michel Reybier, a French citizen. Order 2007-4-30 Issued March 22, 2007 | Served April 30, 2007 By Order 2007-2-25, issued February 28, 2007, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order. No objections were received within the time period provided. We make final our findings and conclusions as stated in the Order and award to Global Jet Austria GMBH. the foreign air carrier permit and conditions attached to the Order. By: Paul Gretch
OST-2008-0012 - Amended Foreign Air Carrier Permit and Exemption - US-EU January 8, 2008 Application for an Amended Foreign Air Carrier Permit and Exemption Authority Global Jet Austria requests an amended foreign air carrier permit to the full extent authorized by the Air Transport Agreement Between the United States and the European Community and the Member States of the European Community to enable it to engage in: a) foreign charter air transportation of persons and property from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) foreign charter air transportation of persons and property between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c) other charters pursuant to the prior approval requirements set forth in Part 212 of the Department's Economic Regulations; and d) transportation authorized by any additional route rights made available to European Community carriers in the future. GJA requests that the authority described above be issued expeditiously. Given that the US-EC Agreement will take effect March 30, 2008, GJA requests that the authority be granted to become effective as of that date or on any earlier date on which the US-EC Agreement is being applied. Order 2008-3-9 Issued and Served March 13, 2008 Order Granting Exemption and to Show Cause We grant the request of Global Jet Austria GMBH for an exemption under 49 U.S.C. §40109 to permit it (1) effective on the issue date of this order, to accept payments, issue tickets, and enter into charter contracts, and (2) effective March 30, 2008, to commence flight operations, for the services set forth below: (a) foreign charter air transportation of persons and property from any point or points behind any Member State of the European Union, via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; (b) foreign charter air transportation of persons and property between any point or points in the United States and any point or points in any member of the European Common Aviation Area; (c) other charters pursuant to the prior approval requirements set forth in the Department’s regulations governing charters; and (d) transportation authorized by any additional rights made available to European Community carriers in the future. To the extent not acted upon above, we dismiss all requests for exemption authority in Docket OST-2008-0012. With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
