Application for an Exemption

Aeromexico respectfully requests an exemption from the provisions of 49 U.S.C. 41301 to the extent necessary to permit Aeromexico to engage in scheduled foreign air transportation of persons, property and mail between Mexico City, Mexico, and Austin, Texas; Guadalajara, Mexico, and Chicago, Illinois; and, Toluca, Mexico, and Las Vegas, Nevada. Aeromexico plans to institute the service on the Mexico City and Toluca routes on or about November 1, 2006, and on the Guadalajara-Chicago route on or about October 1, 2006. The exemption is requested for an initial period of one year.

Aeromexico proposes to offer daily nonstop round trip service between Mexico City and Austin and Guadalajara and Chicago with B-737 aircraft, and two weekly nonstop round trips with MD-87 aircraft between Toluca and Las Vegas.

Notice of Action Taken

Exemption from 49 USC 41301 to permit the applicant to conduct scheduled foreign air transportation of persons, property, and mail between 1) Mexico City, Mexico and Austin, Texas; 2) Guadalajara, Mexico and Chicago, Illinois; and 3) Toluca, Mexico, and Las Vegas, Nevada.

The carrier has informally requested that we act now on the following routes: Guadalajara-Chicago and Toluca- Las Vegas, and defer acting on its request to serve the Mexico City-Austin route.

Notice of Action Taken

Exemption from 49 USC § 41301 to permit the applicant to conduct scheduled foreign air transportation of persons, property, and mail between Mexico City, Mexico and Austin, Texas.

By Notice of Action Taken dated October 19, 2006, in this Docket, we granted Aeromexico's request for exemption authority to conduct scheduled foreign air transportation of persons, property, and mail between 1) Guadalajara, Mexico and Chicago, Illinois; and 2) Toluca, Mexico, and Las Vegas, Nevada. At the applicant's request, we deferred action on Aeromexico's request for exemption authority between Mexico City, Mexico and Austin, Texas. The applicant has now informally requested that we proceed and accordingly, this Notice of Action Taken addresses the remainder of the application.

We are making the duration of this authority coextensive with that of our earlier action in this Docket.

Application for Renewal of an Exemption

By Notice of Action dated October 19, 2006, the Department granted Aeromexico an exemption to engage in scheduled foreign air transportation of persons, property and mail between Guadalajara, Mexico, and Chicago, Illinois, and between Toluca, Mexico, and Las Vegas, Nevada, and it deferred action on Aeromexico's request for Mexico City-Austin authority. Subsequently, by Notice of Action Taken, dated November 11, 2006, it granted the Mexico City-Austin exemption. The exemptions are scheduled to expire on October 19, 2007. Aeromexico is not seeking renewal of the Toluca-Las Vegas authority.

Aeromexico currently offers daily nonstop service with B-737 aircraft in the Guadalajara-Chicago market and daily nonstop service with regional jet aircraft in the Mexico City-Austin market via its wet lease with Aerolitoral, S.A. de C.V. Thus, it seeks to renew the authority for another year.

Notice of Action Taken

Our October 19, 2005 action also awarded Aeromexico authority to operate Toluca, Mexico and Las Vegas, Nevada. Aeromexico states that it is not seeking renewal of that authority.
