Cargoitalia, S.p.A. OST-2006-24736 - Exemption - Italy-US All-Cargo May 3, 2006 On August 23, 2005 the Department of Transportation issued a Notice in Docket OST-2005-22228 announcing new processing procedures for issuance of certificate authority for U.S. and foreign air carriers. Cargoitalia is prepared to begin service between the United States and Italy on May 10 of this year and requests that the Department issue as soon as possible an exemption and a certificate for such service. In light of the immediacy of the start date, Cargoitalia requests that the answer period be shortened to May 5, 2006. Cargoitalia has also filed today an Application for a Foreign Air Carrier Permit seeking authority for the same service, and hereby incorporates by reference that application and accompanying exhibits. Cargoitalia has requested authority to operate all-cargo services between points in the U.S. and points in Italy, and specifically has proposed to operate twice-weekly direct services from Milan Malpensa to Houston and non-stop services from Houston to Milan Malpensa. These services would be of great benefit to businesses in the Greater Houston area, and the Houston Parties accordingly urge that Cargoitalia’s application be granted by the Department. We have decided, under assigned authority and consistent with our August 23, 2005 Notice referenced above, to grant the applicant’s request for exemption authority, subject to conditions, and tentatively to grant, subject to show-cause procedures, its request for a foreign air carrier permit, also subject to conditions. The applicant states that it initially seeks to serve New York (JFK) (three times per week), Atlanta (twice per week), Houston (twice per week) and Chicago (twice per week), using a DC10-30F aircraft. By this order we (1) grant the application of the referenced foreign air carrier for an exemption under 49 U.S.C. 40109, subject to conditions; and (2) tentatively find that it is in the public interest to grant the applicant the foreign air carrier permit.
