Cargoitalia is a new Italian cargo operator that will begin operations in May, 2006. The management team of Cargoitalia is composed of a unique mix of managerial competencies based in two groups: (a) a very qualified and internationally recognized team employed on key business processes such as ground, technical, and flight operations; and (b) bright and young professionals operating in Air Logistics with a variety of background experiences.

Cargoitalia seeks to serve New York (JFK) (three times per week), Atlanta (twice per week), Houston (twice per week), and Chicago (twice per week) with scheduled and charter service of property and mail with DC10-30F / M1SF equipment. This service will be multi-stop service.

First Supplement to Application for a Foreign Air Carrier Permit

Cargoitalia, S.p.A. hereby supplements its application for a Foreign Air Carrier Permit to provide scheduled and charter air transportation of property and mail between Italy and the United States by submitting the following Exhibit to the Application:

Exhibit Cargoitalia-9: Air Operator Certificate l'Aviazione Civile on May 19, 2006.

It is our understanding that a designation from the Italian Government to the Department of State will take place shortly.

Answer and Motion for Leave to File of the City of Houston and the Greater Houston Partnership

The City of Houston and the Greater Houston Partnership respectfully submit this answer in support of the application of Cargoitalia, S.p.A. for a foreign air carrier permit and for an exemption – and to the extent necessary also request leave to file this answer late with respect to the exemption application. Cargoitalia has requested authority to operate all-cargo services between points in the U.S. and points in Italy, and specifically has proposed to operate twice-weekly direct services from Milan Malpensa to Houston and non-stop services from Houston to Milan Malpensa. These services would be of great benefit to businesses in the Greater Houston area, and the Houston Parties accordingly urge that Cargoitalia’s application be granted by the Department.

Order Granting Exemption and to Show Cause

On August 23, 2005, the Department issued a Notice, in Docket OST-2005-22228, announcing several steps designed to streamline our regulatory procedures for licensing U.S. and foreign air carriers.

We have decided, under assigned authority and consistent with our August 23, 2005 Notice referenced above, to grant the applicant’s request for exemption authority, subject to conditions, and tentatively to grant, subject to show-cause procedures, its request for a foreign air carrier permit, also subject to conditions.

The applicant states that it initially seeks to serve New York (JFK) (three times per week), Atlanta (twice per week), Houston (twice per week) and Chicago (twice per week), using a DC10-30F aircraft.

By this order we (1) grant the application of the referenced foreign air carrier for an exemption under 49 U.S.C. 40109, subject to conditions; and (2) tentatively find that it is in the public interest to grant the applicant the foreign air carrier permit.

By Order 2006-6-28, issued June 23, 2006, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto.  We gave interested persons 21 days to file objections to the Order.  We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.

We make final our findings and conclusions as stated in the Order and award to Cargoitalia, S.p.A. the foreign air carrier permit and conditions attached to the Order.
