Order Revoking Certificate Authority

By Order 1998-7-6, issued July 8, 1998, we reissued to Olson a certificate under 49 U.S.C. 41102 to engage in interstate scheduled air transportation of persons, property, and mail. The air carrier operated under its certificate until February 20, 2005, when it ceased all flights.

Section 204.7 of our rules states that an air carrier that ceases the operations for which it was found fit shall not resume operations without first having its fitness redetermined by the Department. Further, if the air carrier has not filed an application to have its fitness redetermined within one year of the date of cessation, its authority will be revoked for dormancy.

By letter dated March 11, 2005, the Department advised Olson that, pursuant to section 204.7 of the Department’s Aviation Economic Regulations, its authority was suspended and it could not resume air transportation operations until the Department had redetermined its fitness to do so. We further stated that if Olson did not resume operations by February 20, 2006, its authority would be revoked for dormancy. It has now been more than one year since Olson ceased operations and we have not received an application from Olson to have its fitness redetermined.

Under these circumstances and in accordance with section 204.7 of our rules, we find it appropriate to revoke Olson's certificate authority. This action is without prejudice to the company’s filing for new certificate authority in the future.
