By Order 2006-2-4, served February 6, 2006, the Department found that GAC was fit to conduct scheduled passenger service as a commuter air carrier.  Under the terms of Order 2006-2-4, the authority was not to become effective until six (business) days after the Department had received (1) a copy of GAC’s Air Carrier Certificate and Operations Specifications from the Federal Aviation Administration authorizing it to engage in scheduled passenger service, (2) evidence of liability insurance coverage that meets the requirements of section 205.5(b) for all its aircraft, (3) a statement of any changes it had undergone in areas affecting its fitness subsequent to the issuance date of the show cause order in this proceeding, and (4) updated financial information and evidence that GAC still had available to it funds sufficient to meet the Department’s financial fitness criteria.

On February 2, 2006, GAC filed updated fitness information, including third-party verification of its available funding and evidence of its appropriate liability insurance.  The company also provided a statement confirming that it had not undergone any changes in its ownership, management, operations, financial posture, and compliance disposition since the Department issued its Show Cause Order on December 23, 2005.

On February 6, 2006, GAC provided a copy of its amended Operations Specifications reflecting FAA authority for scheduled passenger service as a commuter air carrier.  Our review of these documents was satisfactory.  Shortly thereafter, on February 7, 2006, the company requested that the Department waive the six-day waiting period and make its authority effective as soon as possible.

Under these circumstances, we concluded that there was no reason not to grant the company the waiver it requested and make its authority effective prior to the expiration of the six-day waiting period.  Thus, on February 7, 2006, we orally advised GAC that we were making its commuter authority effective on that date.  By this order, we confirm that action and reissue to GAC its commuter air carrier authorization to reflect its effective date.
