Delta Air Lines, Inc. and Aerovias de Mexico, S.A. de C.V. OST-2005-23381 - Exemption and Statement of Authorization - New York/Newark-Monterrey December 15, 2005 Joint Application for an Exemption and Statement of Authorization Delta Air Lines, Inc. and Aerovias de Mexico, S.A. de C.V. hereby apply for authority to expand their codeshare arrangement to include the display of Delta’s code on flights operated by Aeromexico between New York and Monterrey. The Joint Applicants plan to introduce the proposed New York-Monterrey codeshare services within 90 days of the approval of this application and request that the exemption and statement of authorization be granted as soon as possible so that Delta is able to market and sell nonstop New York-Monterrey service without delay. Delta requests that its exemption authority be effective for a period of at least two years, or until 90 days after it is granted certificate authority for this route, whichever occurs earlier. The Joint Applicants request that the codesharing statement of authorization remain in effect indefinitely, consistent with the duration of the U.S.-Mexico codeshare authorities granted by Order 1999-6-6. Delta plans to display its “DL” designator code on nonstop New York-Monterrey flights that Aeromexico has recently reinstated. Delta/Aeromexico previously provided codeshare service on this route, but that service was discontinued. See Notice of Action Taken dated July 25, 2001 (Docket OST-2001-10174). As a result, Delta allowed its exemption authority for this route, last renewed by Notice of Action Taken dated June 10, 2003 in the same docket, to expire. Aeromexico continues to hold New York-Monterrey exemption authority. See Notice of Action Taken dated May 25, 2005 (Docket OST-2000-8374). Permit Aeromexico to display Delta’s “DL” code on flights operated by Aeromexico between New York, New York/Newark, New Jersey, and Monterrey, Mexico.
