Joint Application for an Exemption and Statement of Authorization

Delta Air Lines, Inc. and Aerovias de Mexico, S.A. de C.V. hereby apply for authority to expand their codeshare arrangement to include the display of Delta’s code on flights operated by Aeromexico between New York and Monterrey.

The Joint Applicants plan to introduce the proposed New York-Monterrey codeshare services within 90 days of the approval of this application and request that the exemption and statement of authorization be granted as soon as possible so that Delta is able to market and sell nonstop New York-Monterrey service without delay. Delta requests that its exemption authority be effective for a period of at least two years, or until 90 days after it is granted certificate authority for this route, whichever occurs earlier. The Joint Applicants request that the codesharing statement of authorization remain in effect indefinitely, consistent with the duration of the U.S.-Mexico codeshare authorities granted by Order 1999-6-6.

Delta plans to display its “DL” designator code on nonstop New York-Monterrey flights that Aeromexico has recently reinstated. Delta/Aeromexico previously provided codeshare service on this route, but that service was discontinued. See Notice of Action Taken dated July 25, 2001 (Docket OST-2001-10174). As a result, Delta allowed its exemption authority for this route, last renewed by Notice of Action Taken dated June 10, 2003 in the same docket, to expire. Aeromexico continues to hold New York-Monterrey exemption authority. See Notice of Action Taken dated May 25, 2005 (Docket OST-2000-8374).

Scheduled foreign air transportation of persons, property, and mail between New York, New York/Newark, New Jersey, and Monterrey, Mexico, and to combine this authority with Delta’s existing exemption and certificate authority consistent with applicable international agreements.

Permit Aeromexico to display Delta’s “DL” code on flights operated by Aeromexico between New York, New York/Newark, New Jersey, and Monterrey, Mexico.

Aeromexico currently holds exemption authority to serve the New York-Monterrey market (see Notice of Action Taken dated May 25, 2005, in Docket OST-2000-8374).

Dormany Notices and Notices of Cessation of Codesharing

Delta Air Lines, Inc. hereby notifies the Department of the dormancy of the following routes:

  1. New York/Newark-Acapulco (Docket OST-2005-22243). Delta's final scheduled flight on this route took place on March 31, 2007.
  2. Atlanta-Merida (Docket OST-2005-22243). Delta does not intend to resume seasonal Atlanta-Merida service with its own aircraft during peak periods, but plans to continue to serve this route on a codeshare basis with Delta Connection carrier Atlantic Southeast Airlines, Inc. Accordingly, Delta hereby requests that its designation be converted to a codeshare-only authorization.
  3. Atlanta-Ixtapa/Zihuatanejo (Docket OST-2005-22620). By letter dated October 17, 2006, Delta notified the Department that the Atlanta-Ixtapa/Zihuatenejo route would be transitioned to seasonal service. Delta has now determined that it will not resume peak season service on this route.

Delta also hereby notifies the Department that its "DL*" designator code will no longer be displayed on Aeromexico flights on the following U.S.-Mexico routes:

  1. Las Vegas-Hermosillo (Docket OST-2000-7022);
  2. Salt Lake City-Hermosillo (Docket OST-2001-10438);
  3. Salt Lake City-Mexico City (Docket OST-2001-10438);
  4. New York-Acapulco (Docket OST-2001-10691);
  5. New York-Puerto Vallarta (Docket OST-2001-10691);
  6. Orlando-Monterrey (Docket OST-2003-15252);
  7. Boston-Cancun (Docket OST-2003-16555); and
  8. New York-Monterrey (Docket OST-2005-23381).
