Gazpromavia Aviation Company Ltd. OST-2005-22883 - Exemption - Russian Federation-US All-Cargo Charter Service November 2, 2005 GAZPROMAVIA Aviation Company Ltd. hereby applies for an exemption from 49 U.S.C. § 41302 and such other statutes and the Department's Regulations as may be required, to engage in charter all-cargo service between the Russian Federation and the United States. GAZPROMAVIA intends to start its charter service in December of 2005 primarily utilizing its AN-74 and IL-76 equipment. GAZPROMAVIA requests that its exemption be granted for a period of one year or until 90 days after the transmission of a final order to the President on GAZPROMAVIA's contemporaneously filed application for a foreign air carrier permit, whichever comes first. Counsel: The Wicks Group, Glenn Wicks, 202-457-7790, gpwicks@wicks-group.com OST-2005-22883 - Exemption - Russian Federation-US All-Cargo Charter Service November 11, 2005 Amendment No. 1 to Application for Exemption GAZPROMAVIA requests that its exemption be granted for a period of one year or until 90 days after the transmission of a final order to the President on GAZPROMAVIA's contemporaneously filed and amended application for a foreign air carrier permit, whichever comes first. Subsequent to its referenced application, GAZPROMAVIA completed negotiations for, and obtained, additional insurance that would enable it to operate not only cargo but also passenger and combination services between the Russian Federation and the United States. GAZPROMAVIA’s insurance coverage, as amended, satisfies the requirements set forth in 14 C.F.R. Part 205. See Exhibit GZ-7, as amended. As was stated in its initial application, in accordance with the terms of the U.S.-Russia Air Transport Agreement and Annexes thereto, GAZPROMAVIA has been designated as a charter passenger, combination and all-cargo carrier to provide services between Russia and the United States. However, GAZPROMAVIA initially only requested all-cargo charter authority due to then pending negotiations with its insurer for additional coverage, as required for passenger and combination service. GAZPROMAVIA has today filed an amendment to its application under 49 U.S.C. § 41302, for a foreign air carrier permit that would authorize the services requested by this application. GAZPROMAVIA is filing this exemption application in order to obtain exemption authority as soon as possible. GAZPROMAVIA will primarily utilize Antonov AN-74 and Ilyushin IL-76 aircraft, or such other aircraft that it may have or acquire, to conduct the proposed operations. We have decided, under assigned authority and consistent with our August 23, 2005 Notice referenced above, to grant the applicant’s request for exemption authority, subject to conditions, and tentatively to grant, subject to show-cause procedures, its request for a foreign air carrier permit, also subject to conditions. With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final.
