Application for a Foreign Air Carrier Permit - Bookmarked

Pursuant to 49 U.S.C. 841302 and Parts 211 and 302 of the Department’s Rules of Practice, TUI Airlines Nederland, B.V., d/b/a TUI Airlines Nederland; d/b/a Arkefly hereby submits its application for a foreign air carrier permit authorizing it to engage in the charter air transportation of persons, property and mail between a point or points in the Netherlands, on the one hand, and a point or points in the United States, on the other hand, either directly or via intermediate points in other countries, and beyond, as authorized by the October 14, 1992 U.S.-Netherlands “Open Skies” Agreement.

Applicant plans to initiate U.S. passenger charter operations with its fleet of four B-767-300 (configured for 272Y pax), and the airline intends to initially provide passenger charter service between The Netherlands on the one hand, and points in Florida, on a once-per-week basis.

Pursuant to Rule 12 of the Department’s Rules of Practice, 14 C.F.R. 5302.12, TUI Airlines Nederland, B.V. hereby moves to withhold from public disclosure the contents of the following exhibits to TUI Airlines’s application requesting an exemption to engage in charter foreign air transportation of persons and property, which is simultaneously being filed with the Department: TUI- 1 3 Financial Information for TUI Airlines Nederland, B.V. and TU1 Nederland, N.V.

Order Granting Exemption and to Show Cause

We grant the request of Tui Airlines Nederland for an exemption under 49 USC 40109 to permit it to engage in charter foreign air transportation of persons, property and mail between a point or points in the Netherlands, on the one hand, and a point or points in the United States, on the other hand, either directly or via intermediate points in other countries, and beyond, as authorized by the 1957 US-Netherlands Air Transport Services Agreement, as amended.

By Order 2006-1-5, issued January 10, 2006, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to that Order and subject to the conditions attached to that permit.  We gave interested persons 21 days to file objections to the Order.  We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order which will make final the findings and conclusions of that Order.

No objections were received within the time period provided.

We award to Tui Airlines Nederland, B.V. the foreign air carrier permit.
