Lan Argentina intends to operate daily roundtrip scheduled service between Buenos Aires and Miami utilizing B767‑300 aircraft wet‑leased from Lan Airlines S.A. Service will begin on October 1, 2005. Flights will be timed to provide late evening departures with early morning arrivals in Miami and Buenos Aires. Consistent with its Argentine license and the terms of the bilateral agreement between the United States and Argentina, Lan Argentina requests from the Department an exemption permitting it to engage in charters and the scheduled foreign air transportation of persons, property and mail between any point or points in Argentina, on the one hand, and Miami, on the other hand.

Lan Argentina is a new carrier that began operations in June 2005. With its fleet of four B737-200 aircraft, Lan Argentina currently serves domestic Argentine routes including Buenos Aires-Cordoba and Buenos Aires-Mendoza. Lan Argentina plans to expand its domestic and international services as additional aircraft are acquired over the next several months, and will acquire three additional B737 aircraft by year-end.

Application for Amendment of Exemption

Aero 2000 S.A. d/b/a Lan Argentina hereby requests amendment of its exemption in the captioned docket permitting it to engage in the scheduled foreign air transportation of persons, property and mail between any point or points in Argentina and Miami, Florida. Lan Argentina's exemption authority currently limits it to conducting operations only with aircraft wet leased from Lan Airlines, S.A. Lan Argentina requests that its exemption be amended to include the ability to use Lan Argentina's own aircraft and crews as well as aircraft wet leased from an authorized carrier.

Lan Argentina's initial exemption application was submitted to the Department in August 2005 while Argentina was in Category 2 under the Federal Aviation Administration's International Aviation Safety Assessment program. As a result, Lan Argentina agreed to accept a condition in its operating authority requiring that it conduct operations to and from the United States using only aircraft wet leased from an authorized carrier, in this case Lan Airlines.

On October 21, 2005, the FAA raised Argentina's safety assessment rating to Category 1, finding that the Government of Argentina licenses and oversees Argentine carriers in accordance with International Civil Aviation Organization standards. As a result of the FAA's findings and its placement of Argentina in Category 1 under the IASA program, Argentine carriers may now serve the United States using their own aircraft and crews, and are no longer subject to the requirement that they conduct operations only with aircraft wet leased from an authorized carrier. In serving the United States, Lan Argentina will utilize only modem aircraft that meet all applicable regulatory requirements, and will ensure that the aircraft are maintained in accordance with programs that comply fully with the provisions of ICAO Pilots and Airmen Annexes 1, 6 (Part 1) and 7 as well as with all requirements of the FAA applicable to foreign-registered aircraft utilized in operations to the United States.

Notice of Action Taken

Amend exemption from 49 U.S.C. § 41301, issued on September 30, 2005, in the present Docket, which permits the applicant to engage in scheduled foreign air transportation of persons, property, and mail between any point or points in Argentina and Miami, Florida, using aircraft wet-leased from Lan Airlines, S.A., so as to permit the applicant to use its own aircraft and crews as well as aircraft wet-leased from a duly authorized and properly supervised U.S. or foreign air carrier.

In Lan Argentina’s initial application for operating authority in this Docket, filed August 12, 2005, the carrier stated that it would be conducting the operations at issue here by wet-leasing aircraft from Lan Airlines, S.A., a foreign air carrier of Chile. At that time, and at the time of our September 30, 2005 action approving the application, Lan Argentina’s homeland of Argentina was assessed in Category 2 of the Federal Aviation Administration’s International Aviation Safety Assessment program. The FAA has since performed a new IASA assessment on Argentina, resulting in a rating of Category 1.

Application for Amendment of Exemption

Lan Argentina hereby requests amendment of its exemption in the captioned docket to allow it to engage in scheduled foreign air transportation of persons, property and mail between points in Argentina and Miami, Florida, via the intermediate point Punta Cana, Dominican Republic. Lan Argentina's exemption authority currently limits it to conducting nonstop services between Argentina and Miami. By this amendment application, Lan Argentina requests authority to serve Punta Cana as an intermediate point on its services between Argentina and Miami. Lan Argentina intends to begin service via Punta Cam on November 18, 2006, and requests prompt approval of this application so that sale of this service may begin without delay. Lan Argentina also requests that its amended exemption be granted through June 14, 2007, consistent with its existing authority in this docket.

Lan Argentina requests amendment of its exemption to permit it to serve Miami via the intermediate point Punta Cana, Dominican Republic, on Lan Argentina's Argentina-Miami flights. Lan Argentina plans to initially serve Punta Cana once weekly utilizing B767-300 aircraft. Service lo Miami via Punta Cam will begin November 18, 2006.

LAN Argentina S.A. hereby requests renewal of exemptions in this docket that authorize it to engage in scheduled foreign air transportation of persons, property and mail between any point or points in Argentina and Miami, Florida, and that permit LAN Argentina to perform these services with an intermediate stop in Punta Cana, Dominican Republic. LAN Argentina also requests that its renewed exemptions be issued in its new corporate name, LAN Argentina S.A.

LAN Argentina requests that the authority sought herein remain in effect for a period of not less than two years.

LAN Argentina's exemption authorities in this docket have been granted in the name of AERO 2000 S.A. d/b/a LAN ARGENTINA. By decree of the Ministry of Justice of Argentina dated January 16, 2006, the legal name of the airline was changed from AERO 2000 S.A. to LAN ARGENTINA S.A.
