Air Wisconsin Airlines Corporation OST-2005-21903 - Air Wisconsin - Interim and Indefinite Statements of Authorization - Codeshare with Lufthansa July 14, 2005 Application for Interim and Indefinite Statements of Authorization AWAC will operate its own aircraft with its own crews on behalf of US Airways under the "US Airways Express" name pursuant to an agreement between US Airways and AWAC approved by the US Airways bankruptcy court on or about February 28,2005- Service will comence under this agreement on or about the 13th of August 2005. US Airways and Lufthansa hold authority from the Department of Transportation to engage in codesharing on a reciprocal basis pursuant to an alliance agreement between those carriers. AWAC is not an original party to that agreement, but Lufthansa, US Airways and AWAC have negotiated a codeshare agreement letter adding AWAC as a party to the US Airways/Lufthansa agreement. AWAC will file the letter agreement adding AWAC as a party to the US Airways/Lufthansa agreement as soon as it is executed. An interim statement of authorization approving the codeshare service is immediately needed to insure that there is no interruption of Lufthansa codeshare service as the transition to AWAC is accomplished. AWAC requests that DOT incorporate by reference all code-share city pairs previously notified to the Department by US Airways/Lufthansa in Docket OST-2003-15946 in any Order issued in response this pleading. Further AWAC requests that the Department consider notice of any change of city pairs by US Airways, Lufthansa or AWAC, as a US Airways Express carrier, as notice on behalf of all such carriers. Such an approach, consistent with established practice, which will minimize the administrative burden on the Department and each of the carriers, is necessary in order to accommodate routine US Airways Express schedule and other operational changes. July 19, 2005 Poll on Application for Interim and Indefinite Statements of Authorization Air Wisconsin Airlines Corporation has polled the representatives of all the U.S. air passenger carriers served with the referenced application. September 13, 2005 Air Wisconsin Airlines Corporation, pursuant to 14 C.F.R. Part 212, and Department's Action on Application in Docket OST-2005-21903, submits the codeshare agreement as required in the Action on Application and renews its request for issuance of an indefinite Statement of Authorization approving AWAC's codeshare with Deutsche Lufthansa AG as more fully set out herein and AWAC's original filing dated July 14, 2005. Filed July 14, 2005 / Supplemented September 13, 2005 | Approved September 28, 2005 AWAC sough both an interim and indefinite blanket statement of authorization to display the Lufthansa “LH” designated code on all flights operated by AWAC on behalf of US Airways under the existing US Airways-Lufthansa code-share agreement. We granted AWAC a waiver for the interim authority for a period of 90 days so that it could operate its proposed service but within the period, AWAC had to submit an agreement establishing AWAC as a party to the US Airways-Lufthansa code share agreement. See Decision dated August 4, 2005. We deferred action on the indefinite authority until AWAC, Lufthansa and US Airways submitted the above information.
