Application for an Exemption

Seeks an exemption authorizing it to engage in scheduled foreign air transportation of persons, property and mail between DEN and ACA. Frontier plans initially to operate this service on a twice weekly (Thursday/Sunday) basis during peak season with operation of the service commencing December 18, 2005 and continuing through May 2006. Frontier intends to resume this pattern of seasonal service in subsequent years.

Although no other carrier currently operates DEN-ACA service, as soon as carriers such as Frontier and other small carriers propose service to markets in Mexico, legacy carriers, regardless of their financial situation, immediately respond by proposing identical service. To many of these carriers, the need to reduce costs to return to profitability takes a back seat to challenging a competitor.

Re: Dormancy Notice

Frontier Airlines, Inc. hereby notifies the Department of the dormancy of Frontier's service on the Denver to Acapulco, Mexico route, effective immediately. This service was granted by the Department's Notice of Action Taken issued August 31, 2005 in Docket OST-2005-21838 and is due to expire on August 31, 2007.

In recent months, there has been a significant decrease in demand for Acapulco service. Due to the change in demand for the service, Frontier will suspend service on the DEN-ACA route. Demand to other Mexico markets continues to expand. Rather than resuming its seasonal service to Acapulco in December 2007, Frontier will allow the route to go dormant until December 2008. This dormancy request is longer than the typical one-year period because the service is seasonal and this request will only skip one service period (December 2007 through April 2008) It is Frontier's hope that demand for Acapulco service will be restored and the travel demand will return to the area by December 2008.

Frontier will poll the individuals on the attached service list for approval of this dormancy waiver and will inform the Department of the results of that polling.

Application for Renewal of Existing Exemption Authority

Frontier requests that its exemption authority to operate these services be extended two years in accordance with Departmental policy. Although Frontier has requested that the Department grant a Dormancy Waiver for this route (Docket OST-2005-21838), Frontier is prepared to resume the DEN-ACA in December 2008. Frontier is fit, willing, and able to perform the DEN-ACA service at that time using Airbus A-319-111 aircraft, with an average seat configuration of 132 seats. Frontier reserves the right to serve these routes with other aircraft from its fleet.

The extended authority requested will enable Frontier to resume service to Acapulco in December 2008 when the demand for nonstop service between Denver and Acapulco has been restored.

Re: Polling Results

On July 12, 2007, Frontier Airlines notified the Department of the dormancy of Frontier's service on the Denver to Acapulco, Mexico route and requested a dormancy waiver. We have polled the U.S. carrier representatives served with the above-referenced notice, and no carrier has objected to Frontier's request.

Withdrawal of Application for Renewal of Existing Exemption Authority and Request for Dormancy

Frontier Airlines, Inc. herewith gives notice of withdrawal of its application pending in this Docket for renewal of its exemption authority to continue scheduled foreign air transportation between Denver, Colorado and Acapulco, Mexico. Frontier will not seek renewal of this exemption. Frontier also hereby withdraws its July 12, 2007 dormancy request in the same Docket.
